90_SB0129sam001 SRS90S0129PMcham01 1 AMENDMENT TO SENATE BILL 129 2 AMENDMENT NO. . Amend Senate Bill 129 by replacing 3 everything after the enacting with the following: 4 "Section 5. The Election Code is amended by adding 5 Section 29-14.5 as follows: 6 (10 ILCS 5/29-14.5 new) 7 Sec. 29-14.5. Publication of fraudulent pictures. No 8 person, during the course of any campaign for nomination or 9 election to public office or office of a political party, 10 shall knowingly distribute, publish, or broadcast campaign 11 materials that contain an altered or fraudulent picture. 12 Campaign materials shall include, but are not limited to, all 13 printed matter, television commercials, advertisements in a 14 newspaper or periodical, a public speech or press release, or 15 any other materials for distribution. Candidates are 16 responsible for the materials published or broadcast by their 17 political committees. Nothing contained in this Section 18 shall require the publisher of the advertisement to verify 19 the accuracy of the content provided by the advertiser. 20 Altered or fraudulent pictures are those which 21 substantially alter the identity of an individual or 22 otherwise substantially alter the facts contained in the -2- SRS90S0129PMcham01 1 picture. 2 Any candidate or political party that violates this 3 Section shall be liable for the cost of distributing, 4 publishing, or broadcasting, in the same manner and degree as 5 the original distribution, publication, or broadcast, a 6 public acknowledgment that the campaign materials were 7 altered or fraudulent. The public acknowledgment shall 8 include the original unaltered picture.".
