The Criminal Code of 1961 is amended by 6 changing Section 31-5 as follows: 7 (720 ILCS 5/31-5) (from Ch. 38, par. 31-5) 8 Sec. 31-5. Concealing or aiding a fugitive. 9 (a) Except as otherwise provided in subsection (b), 10 every person not standing in the relation of husband, wife, 11 parent, child, brother or sister to the offender, who, with 12 intent to prevent the apprehension of the offender, conceals 13 his knowledge that an offense has been committed or harbors, 14 aids or conceals the offender, commits a Class 4 felony. 15 (b) Every person who, with intent to prevent the 16 apprehension of a person accused of a violation of Section 17 9-1 of this Code, does any act in furtherance of preventing 18 the apprehension of that person, commits a Class 3 felony. 19 (c) Nothing in subsection (b) of this Section shall 20 abridge the husband-wife privilege under Section 115-16 of 21 the Code of Criminal Procedure of 1963 or under the common 22 law. 23 (Source: P.A. 77-2638.)
