Makes a change in punctuation and adds a gender neutral reference to provisions relating to qualifications of personnel who teach classes or programs authorized by the Article of the School Code relating to children with disabilities. LRB9004312THpk LRB9004312THpk 1 AN ACT to amend the School Code by changing Section 2 14-9.01. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The School Code is amended by changing 6 Section 14-9.01 as follows: 7 (105 ILCS 5/14-9.01) (from Ch. 122, par. 14-9.01) 8 Sec. 14-9.01. Qualifications of teachers, other 9 professional personnel, and necessary workers. No person 10 shall be employed to teach any class or program authorized by 11 this Article who does not hold a valid teacher's certificate 12 as provided by law and unless he or she has had such special 13 training as the State Board of Education may require. No 14 special certificate or endorsement to a special certificate 15 issued under Section 21.4 on or after July 1, 1994, shall be 16 valid for teaching students with visual disabilities unless 17 the person to whom the certificate or endorsement is issued 18 has attained satisfactory performance on an examination that 19 is designed to assess competency in Braille reading and 20 writing skills according to standards that the State Board of 21 Education may adopt. Evidence of successfully completing the 22 examination of Braille reading and writing skills must be 23 submitted to the State Board of Education prior to an 24 applicant's examination of the subject matter knowledge test 25 required under Section 21-1a. Beginning July 1, 1995, in 26 addition to other requirements, a candidate for a teaching 27 certification in the area of the deaf and hard of hearing 28 granted by the Illinois State Board of Education for teaching 29 deaf and hard of hearing students in grades pre-school 30 through grade 12 must demonstrate a minimum proficiency in 31 sign language as determined by the Illinois State Board of -2- LRB9004312THpk 1 Education. All other professional personnel employed in any 2 class, service, or program authorized by this Article shall 3 hold such certificates and shall have had such special 4 training as the State Board of Education may require; 5 provided that in a school district organized under Article 6 34, the school district may employ speech and language 7 pathologists who are licensed under the Illinois 8 Speech-Language Pathology and Audiology Practice Act but who 9 do not hold a certificate issued under the School Code if the 10 district certifies that a chronic shortage of certified 11 personnel exists. Nothing contained in this Act prohibits 12 the school board from employing necessary workers to assist 13 the teacher with the special educational facilities, except 14 that all such necessary workers must have had such training 15 as the State Board of Education may require. 16 No later than January 1, 1993, the State Board of 17 Education shall develop, in consultation with the Advisory 18 Council on the Education of Children with Disabilities and 19 the Advisory Council on Bilingual Education, rules governing 20 the qualifications for certification of teachers and school 21 service personnel providing services to limited English 22 proficient students receiving special education and related 23 services. 24 The employment of any teacher in a special education 25 program provided for in Sections 14-1.01 to 14-14.01, 26 inclusive, shall be subject to the provisions of Sections 27 24-11 to 24-16, inclusive. Any teacher employed in a special 28 education program, prior to the effective date of this 29 amendatory Act of 1987, in which 2 or more districts 30 participate shall enter upon contractual continued service in 31 each of the participating districts subject to the provisions 32 of Sections 24-11 to 24-16, inclusive. 33 (Source: P.A. 88-45; 88-49; 88-670, eff. 12-2-94; 89-397, 34 eff. 8-20-95; 89-636, eff. 8-9-96; 89-698, eff. 1-14-97.)
