 1                    AMENDMENT TO HOUSE BILL 1618
 2        AMENDMENT NO.     .  Amend House Bill 1618  by  replacing
 3    everything after the enacting clause with the following:
 4        "Section  5.  The  Illinois  Vehicle  Code  is amended by
 5    changing Sections 1-102.02 and 3-101 as follows:
 6        (625 ILCS 5/1-102.02) (from Ch. 95 1/2, par. 1-102.02)
 7        Sec.  1-102.02.   All-terrain  vehicle.   Any   motorized
 8    off-highway vehicle device 50 inches or less in width, having
 9    a  manufacturer's dry weight of 600 pounds or less, traveling
10    on 3 or more low-pressure tires,  designed  with  a  seat  or
11    saddle  for  operator  use  only,  and handlebars or steering
12    wheel for steering control.

15        Sec. 3-101.  Certificate of title required. (a) Except as
16    provided in Section 3-102, every owner of a vehicle which  is
17    in  this State and for which no certificate of title has been
18    issued by the Secretary of State shall  make  application  to
19    the  Secretary  of  State  for  a certificate of title of the
20    vehicle.
21        (b)  Every owner of a motorcycle or  motor  driven  cycle

 1    purchased  new  on and after January 1, 1980, and every owner
 2    of an all-terrain vehicle purchased new on and after  January
 3    1, 1998, shall make application to the Secretary of State for
 4    a  certificate of title.  The fee to be paid to the Secretary
 5    of State for  a  certificate  of  title  for  an  all-terrain
 6    vehicle  is  $13 or as otherwise provided by law. However, if
 7    such cycle is  not  properly  manufactured  or  equipped  for
 8    general  highway  use pursuant to the provisions of this Act,
 9    it shall not be eligible for license registration, but  shall
10    be  issued  a  distinctive  certificate  of  title  except as
11    provided in Sections 3-102 and 3-110 of this Act.
12        (c)  The Secretary of State shall not register  or  renew
13    the  registration  of a vehicle unless a certificate of title
14    has been issued by the Secretary of State to the owner or  an
15    application  therefor  has been delivered by the owner to the
16    Secretary of State.

18        Section 99.   Effective  date.   This  Act  takes  effect
19    January 1, 1998.".
