Amends the Illinois Vehicle Code. Changes definition of
all-terrain vehicle. Increases the maximum manufacturer's dry
weight from 600 pounds to 750 pounds and the minimum number
of low-pressure tires from 3 to 4 to qualify as an
all-terrain vehicle. Provides that an owner of an
all-terrain vehicle purchased new on or after January 1, 1998
must make application to the Secretary of State for a
certificate of title. Effective January 1, 1998.

1 AN ACT to amend the Illinois Vehicle Code by changing
2 Sections 1-102.02 and 3-101.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 changing Sections 1-102.02 and 3-101 as follows:

8 Sec. 1-102.02. All-terrain vehicle. Any motorized
9 off-highway vehicle device 50 inches or less in width, having
10 a manufacturer's dry weight of 750 600 pounds or less,
11 traveling on 4 3 or more low-pressure tires, designed with a
12 seat or saddle for operator use only, and handlebars or
13 steering wheel for steering control.

16 Sec. 3-101. Certificate of title required. (a) Except as
17 provided in Section 3-102, every owner of a vehicle which is
18 in this State and for which no certificate of title has been
19 issued by the Secretary of State shall make application to
20 the Secretary of State for a certificate of title of the
21 vehicle.
22 (b) Every owner of a motorcycle or motor driven cycle
23 purchased new on and after January 1, 1980, and every owner
24 of an all-terrain vehicle purchased new on and after January
25 1, 1998, shall make application to the Secretary of State for
26 a certificate of title. However, if such cycle is not
27 properly manufactured or equipped for general highway use
28 pursuant to the provisions of this Act, it shall not be
29 eligible for license registration, but shall be issued a
30 distinctive certificate of title except as provided in

1 Sections 3-102 and 3-110 of this Act.
2 (c) The Secretary of State shall not register or renew
3 the registration of a vehicle unless a certificate of title
4 has been issued by the Secretary of State to the owner or an
5 application therefor has been delivered by the owner to the
6 Secretary of State.

8 Section 99. Effective date. This Act takes effect
9 January 1, 1998.
