Provides that a political committee's statement of organization, semi-annual report, and report shall contain the name and address of each candidate who may benefit from or have access to committee funds unless the committee's expenditures directly benefit all party candidates. LRB9004241PTcw LRB9004241PTcw 1 AN ACT to amend the Election Code by changing Sections 2 9-3, 9-4, 9-11, 9-12, 9-13, and 9-14. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Election Code is amended by changing 6 Sections 9-3, 9-4, 9-11, 9-12, 9-13, and 9-14 as follows: 7 (10 ILCS 5/9-3) (from Ch. 46, par. 9-3) 8 Sec. 9-3. Statement of organization. Every state 9 political committee and every local political committee shall 10 file with the State Board of Elections, and every local 11 political committee shall file with the county clerk, a 12 statement of organization within 30 days of the creation of 13 such committee. A political committee that acts as both a 14 state political committee and a local political committee 15 shall file a copy of each statement of organization with the 16 State Board of Elections and the county clerk. 17 The statement of organization shall include - 18 (a) the name and address of the political committee; 19 (b) the scope, area of activity, party affiliation, 20 candidate affiliation and his county of residence, and 21 purposes of the political committee; 22 (c) the name, address, and position of each custodian of 23 the committee's books and accounts; 24 (d) the name, address, and position of the committee's 25 principal officers, including the chairman, treasurer, and 26 officers and members of its finance committee, if any; 27 (e) a statement whether the committee is a continuing 28 one; 29 (f) a statement of what specific disposition of residual 30 fund will be made in the event of the dissolution or 31 termination of the committee; -2- LRB9004241PTcw 1 (g) a listing of all banks or other financial 2 institutions, safety deposit boxes, and any other 3 repositories or custodians of funds used by the committee; 4 (h) the amount of funds available for campaign 5 expenditures as of the filing date of the committee's 6 statement of organization;.7 (i) the name and address of each candidate who may 8 benefit from or have access to committee funds unless the 9 committee's expenditures directly benefit all party 10 candidates. 11 (Source: P.A. 86-873.) 12 (10 ILCS 5/9-4) (from Ch. 46, par. 9-4) 13 Sec. 9-4. Statement of organization form. Report. Each report of campaign contributions 14 under Section 9-10 shall disclose- 15 (1) the name and address of the political committee; 16 (2) the scope, area of activity, party affiliation, 17 candidate affiliation, and purposes of the political 18 committee; 19 (3) the amount of funds on hand at the beginning of the 20 reporting period; 21 (4) the full name and mailing address of each person who 22 has made one or more contributions to or for such committee 23 within the reporting period in an aggregate amount or value 24 in excess of $150, together with the amount and date of such 25 contributions; 26 (5) the total sum of individual contributions made to or 27 for such committee during the reporting period and not 28 reported under item (4); 29 (6) the name and address of each political committee 30 from which the reporting committee received, or to which that 31 committee made, any transfer of funds, in any aggregate 32 amount or value in excess of $150, together with the amounts 33 and dates of all transfers; -5- LRB9004241PTcw 1 (7) the total sum of transfers made to or from such 2 committee during the reporting period and not reported under 3 item (6); 4 (8) each loan to or from any person within the reporting 5 period by or to such committee in an aggregate amount or 6 value in excess of $150, together with the full names and 7 mailing addresses of the lender and endorsers, if any, and 8 the date and amount of such loans; 9 (9) the total amount of proceeds received by such 10 committee from (a) the sale of tickets for each dinner, 11 luncheon, cocktail party, rally, and other fund-raising 12 events; (b) mass collections made at such events; and (c) 13 sales of items such as political campaign pins, buttons, 14 badges, flags, emblems, hats, banners, literature, and 15 similar materials; 16 (10) each contribution, rebate, refund, or other receipt 17 in excess of $150 received by such committee not otherwise 18 listed under items (4) through (9); 19 (11) the total sum of all receipts by or for such 20 committee or candidate during the reporting period;.21 (12) the name and address of each candidate who may 22 benefit from or have access to committee funds unless the 23 committee's expenditures directly benefit all party 24 candidates. 25 The reports of campaign contributions filed under this 26 Article shall be cumulative during the reporting period to 27 which they relate, but where there has been no change in an 28 item reported in a previous report during such year, only the 29 amount need be carried forward. 30 (Source: P.A. 86-873.) 31 (10 ILCS 5/9-12) (from Ch. 46, par. 9-12) 32 Sec. 9-12. Report form. Each semi-annual report 23 of campaign contributions and expenditures under Section 9-10 24 shall disclose- 25 (1) the name and address of the political committee; 26 (2) the scope, area of activity, party affiliation, 27 candidate affiliation, and purposes of the political 28 committee; 29 (3) the amount of funds on hand at the beginning of the 30 reporting period; 31 (4) the full name and mailing address of each person who 32 has made one or more contributions to or for such committee 33 within the reporting period in an aggregate amount or value -9- LRB9004241PTcw 1 in excess of $150, together with the amount and date of such 2 contributions; 3 (5) the total sum of individual contributions made to or 4 for such committee during the reporting period and not 5 reported under item (4); 6 (6) the name and address of each political committee 7 from which the reporting committee received, or to which that 8 committee made, any transfer of funds, in the aggregate 9 amount or value in excess of $150, together with the amounts 10 and dates of all transfers; 11 (7) the total sum of transfers made to or from such 12 committee during the reporting period and not reported under 13 item (6); 14 (8) each loan to or from any person within the reporting 15 period by or to such committee in an aggregate amount or 16 value in excess of $150, together with the full names and 17 mailing addresses of the lender and endorsers, if any, and 18 the date and amount of such loans; 19 (9) the total amount of proceeds received by such 20 committee from (a) the sale of tickets for each dinner, 21 luncheon, cocktail party, rally, and other fund-raising 22 events; (b) mass collections made at such events; and (c) 23 sales of items such as political campaign pins, buttons, 24 badges, flags, emblems, hats, banners, literature, and 25 similar materials; 26 (10) each contribution, rebate, refund, or other receipt 27 in excess of $150 received by such committee not otherwise 28 listed under items (4) through (9); 29 (11) the total sum of all receipts by or for such 30 committee or candidate during the reporting period; 31 (12) the full name and mailing address of each person to 32 whom expenditures have been made by such committee or 33 candidate within the reporting period in an aggregate amount 34 or value in excess of $150, the amount, date, and purpose of -10- LRB9004241PTcw 1 each such expenditure and the question of public policy or 2 the name and address of, and office sought by, each candidate 3 on whose behalf such expenditure was made; 4 (13) the full name and mailing address of each person to 5 whom an expenditure for personal services, salaries, and 6 reimbursed expenses in excess of $150 has been made, and 7 which is not otherwise reported, including the amount, date, 8 and purpose of such expenditure; 9 (14) the total sum of expenditures made by such 10 committee during the reporting period; 11 (15) the full name and mailing address of each person to 12 whom the committee owes debts or obligations in excess of 13 $150, and the amount of such debts or obligations;.14 (16) the name and address of each candidate who may 15 benefit from or have access to committee funds unless the 16 committee's expenditures directly benefit all party 17 candidates. 18 (Source: P.A. 86-873.) 19 (10 ILCS 5/9-14) (from Ch. 46, par. 9-14) 20 Sec. 9-14.
