1 AMENDMENT TO HOUSE BILL 1251
2 AMENDMENT NO. . Amend House Bill 1251 by replacing
3 the title with the following:
4 "AN ACT to amend the Election Code by changing Sections
5 9-3 and 9-4."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Election Code is amended by changing
9 Sections 9-3 and 9-4 as follows:
10 (10 ILCS 5/9-3) (from Ch. 46, par. 9-3)
11 Sec. 9-3. Statement of organization. Every state
12 political committee and every local political committee shall
13 file with the State Board of Elections, and every local
14 political committee shall file with the county clerk, a
15 statement of organization within 30 days of the creation of
16 such committee. A political committee that acts as both a
17 state political committee and a local political committee
18 shall file a copy of each statement of organization with the
19 State Board of Elections and the county clerk.
20 The statement of organization shall include -
21 (a) the name and address of the political committee;

1 (b) the scope, area of activity, party affiliation,
2 candidate affiliation and his county of residence, and
3 purposes of the political committee;
4 (c) the name, address, and position of each custodian of
5 the committee's books and accounts, including the name and
6 address of the candidate, officer, or other person who has
7 authority to decide how committee funds are to be disbursed;
8 (d) the name, address, and position of the committee's
9 principal officers, including the chairman, treasurer, and
10 officers and members of its finance committee, if any;
11 (e) a statement whether the committee is a continuing
12 one;
13 (f) a statement of what specific disposition of residual
14 fund will be made in the event of the dissolution or
15 termination of the committee;
16 (g) a listing of all banks or other financial
17 institutions, safety deposit boxes, and any other
18 repositories or custodians of funds used by the committee;
19 (h) the amount of funds available for campaign
20 expenditures as of the filing date of the committee's
21 statement of organization.

24 Sec. 9-4. Statement of organization form. The statement
25 of organization required by this Article to be filed in
26 accordance with Section 9-3 shall be verified, dated, and
27 signed by either the treasurer of the political committee
28 making the statement or the candidate on whose behalf the
29 statement is made, and shall contain substantially the
30 following:

32 (a) name and address of the political committee:

4 any accompanying schedules and statements) has been examined
5 by me and to the best of my knowledge and belief is a true,
6 correct and complete statement of organization as required by
7 Article 9 of The Election Code. I understand that the penalty
8 for willfully filing a false or incomplete statement shall be
9 a fine not to exceed $500 or imprisonment in a penal
10 institution other than the penitentiary not to exceed 6
11 months, or both fine and imprisonment."

16 Section 99. Effective date. This Act takes effect
17 January 1, 1998.".
