1 AMENDMENT TO HOUSE BILL 1122
2 AMENDMENT NO. . Amend House Bill 1122 on page 1, by
3 deleting lines 25 through 29; and
4 on page 1, in line 30, by replacing "(C)" with "(A)"; and
5 on page 2, in line 3, by replacing "(D)" with "(B)"; and
6 on page 2, in line 7, by replacing "(E)" with "(C)"; and
7 on page 2, in line 9, by replacing "(F)" with "(D)"; and
8 on page 2, in line 15, by replacing "(G)" with "(E)"; and
9 on page 2, in line 18, by deleting "or"; and
10 on page 2, immediately below line 18, by inserting the
11 following:
12 "(2) any empty portable device or container,
13 including but not limited to a drum, in which a special
14 waste has been stored, transported, treated, disposed of,
15 or otherwise handled, provided that the generator has
16 certified that the device or container is empty and does
17 not contain a liquid, as determined pursuant to item (C)
18 of subdivision (1) of this subsection. For purposes of
19 this subdivision, "empty portable device or container"
20 means a device or container in which removal of special

1 waste, except for a residue that shall not exceed one
2 inch in thickness, has been accomplished by a practice
3 commonly employed to remove materials of that type. An
4 inner liner used to prevent contact between the special
5 waste and the container shall be removed and managed as a
6 special waste; or"; and
7 on page 2, in line 19, by replacing "(2)" with "(3)"; and
8 on page 3, in line 2, by replacing "certification." with
9 "certification; effect on permit."; and
10 on page 3, by replacing lines 28 and 29 with "generating the
11 waste."; and
12 on page 3, in line 31, by replacing "on site" with "by the
13 certifying generator while effective and for at least 3 years
14 following a change in the generator, a change in the raw
15 materials used, or a change in or termination of the process
16 generating the waste"; and
17 on page 4, in line 1, after "copy.", by inserting the
18 following:
19 "If the Agency believes that the waste that is the subject of
20 the certification has been inaccurately certified to, the
21 Agency may require the generator to analytically test the
22 waste for the constituent believed to be present and provide
23 the Agency with a copy of the analytic results."; and
24 on page 4, by inserting below line 5 the following:
25 "(f) To the extent that a term or condition of an
26 existing permit requires the permittee to manage as special
27 waste a material that is made a non-special waste under this
28 amendatory Act of 1997, that term or condition is hereby
29 superseded, and the permittee may manage that material as a
30 non-special waste, even if the material is identified in the
31 permit as part of a particular waste stream rather than

1 identified specifically as a special waste.".
