Establishes a pilot program in Cook, DuPage, and Kane Counties for certain juvenile offenders who have been released from facilities of the Juvenile Division of the Department of Corrections. Establishes programs designed to reintegrate the offenders into the community. Provides that the participants in the pilot program shall have access to needs assessment, case management, secure care, therapeutic treatment, drug rehabilitation programs, transitional programs to independent living, substitute care, and housing alternatives. LRB9000995RCksC LRB9000995RCksC 1 AN ACT to amend the Unified Code of Corrections by adding 2 Article 16 to Chapter III. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Unified Code of Corrections is amended by 6 adding Article 16 to Chapter III as follows: 7 (730 ILCS 5/Chap. III, Art. 16 heading new) 8 ARTICLE 16. PILOT PROGRAM FOR CERTAIN JUVENILES 9 (730 ILCS 5/3-16-5 new) 10 Sec. 3-16-5. Pilot program; releasees from the Juvenile 11 Division of the Department of Corrections. 12 (a) There is established in the Counties of Cook, 13 DuPage, and Kane a pilot program for persons released from 14 the Juvenile Division of the Department of Corrections. 15 (b) A person who is being released from the Juvenile 16 Division of the Department of Corrections under subsection 17 (e) of Section 3-3-3 whom the Juvenile Division deems a 18 serious delinquent youth likely to have difficulty adjusting 19 to the community, and to have significant clinical problems 20 who is returning to Cook County, DuPage County, or Kane 21 County shall be eligible for the pilot program. 22 (c) The Department of Corrections, Juvenile Division, 23 shall provide services to persons described in subsection (b) 24 that shall ensure that these persons receive services to 25 prepare them for reintegration into the community and to 26 minimize the likelihood of their recidivism. 27 (d) The participants in the pilot program shall have 28 access to the following services: 29 (1) needs assessment; 30 (2) case management; -2- LRB9000995RCksC 1 (3) secure care; 2 (4) residential treatment by licensed providers; 3 (5) intensive outpatient treatment; 4 (6) structured day programs; 5 (7) therapeutic day treatment; 6 (8) outpatient treatment; 7 (9) transitional programs to independent living; 8 (10) substitute care; and 9 (11) housing alternatives. 10 (e) Needs assessment shall be performed prior to an 11 eligible person's release from the Juvenile Division of the 12 Department of Corrections. The assessment shall include 13 educational, psychological, vocational, and substance abuse 14 treatment needs of potential participants. There shall be a 15 special assessment of those persons committed to a facility 16 of the Juvenile Division of the Department of Corrections who 17 have a history of committing sex offenses. After the needs 18 assessment, a clinical discharge plan shall be developed for 19 each committed person eligible for admission to the pilot 20 program. The discharge plan shall be approved by the 21 Department before the committed person is discharged from the 22 Department facility. 23 (f) The Department shall promulgate rules to establish 24 sanctions for participants in the program who fail to comply 25 with the program prescribed. These sanctions may include the 26 recommitment of a participant to a facility of the Juvenile 27 Division of the Department of Corrections. 28 (g) The Department shall select a community-based 29 network to provide the services specified in subsection (d).
