The Higher Education Student Assistance Act 5 is amended by changing Section 37 as follows: 6 (110 ILCS 947/37) 7 Sec. 37. Higher education license plate grant program. 8 (a) Each year, the Illinois Student Assistance 9 Commission shall receive a separate appropriation for the 10 purpose of providing grant assistance to students enrolled at 11 Illinois private colleges and universities.The Commission12shall, each year, receive and consider applications for grant13assistance under this Section.Subject to a separate 14 appropriation for such purposes, an applicant is eligible for 15 a grant to a degree-granting, not-for-profit private college 16 or university located in this State under this Section when 17 the Commission finds that the applicant: 18 (1) is a resident of this State and a citizen or 19 permanent resident of the United States; and 20 (2) in the absence of grant assistance, will be 21 deterred by financial considerations from completing an 22 educational program at the qualified institution of his -2- LRB9002561THpkam 1 or her choice. 2 (b) The private college or universityCommissionshall 3 award renewals only upon the student's application and upon 4 the institution'sCommission'sfinding that the applicant: 5 (1) has remained a student in good standing at a 6 degree-granting, not-for-profit private college or 7 university located in this State; 8 (2) remains a resident of this State; and 9 (3) is in a financial situation that continues to 10 warrant assistance. 11 (c) All grants shall be applicable only to tuition and 12 necessary fee costs for 2 semesters or 3 quarters in an 13 academic year. Requests for summer term assistance must be 14 made separately and shall be considered on an individual 15 basis according to Commission policy. The institution 16Commissionshall determine the grant amount for each 17 full-time and part-time student, which shall be the smallest 18 of the following amounts: 19 (1) $2,000 for 2 semesters or 3 quarters of 20 full-time undergraduate enrollment or $1,000 for 2 21 semesters or 3 quarters of part-time undergraduate 22 enrollment, or such lesser amount as the Commission finds 23 to be available; or 24 (2) the amount that equals the tuition and other 25 necessary fees for 2 semesters or 3 quarters required 26 generally by the institution of all full-time 27 undergraduate students, or in the case of part-time 28 students an amount of tuition and fees for 2 semesters or 29 3 quarters that does not exceed one-half the amount of 30 tuition and necessary fees generally charged to full-time 31 undergraduate students by the institution; or 32 (3) such amount as the institutionCommissionfinds 33 to be appropriate in view of the applicant's financial 34 resources. -3- LRB9002561THpkam 1 "Tuition and other necessary fees" as used in this Section 2 includes the customary charge for instruction and use of 3 facilities in general, and the additional fixed fees charged 4 for specified purposes, which are required generally of 5 nongrant recipients for each academic period for which the 6 grant applicant actually enrolls, but does not include fees 7 payable only once or breakage fees and other contingent 8 deposits that are refundable in whole or in part. The 9 Commission may prescribe, by rule not inconsistent with this 10 Section, detailed provisions concerning the computation of 11 tuition and other necessary fees. 12 (d) No applicant, including those presently receiving 13 scholarship assistance under this Act, is eligible for grant 14 program consideration under this Section after receiving a 15 baccalaureate degree or the equivalent of 10 semesters or 15 16 quarters of award payments. The institutionCommissionshall 17 determine when award payments for part-time enrollment or 18 interim or summer terms shall be counted as a partial 19 semester or quarter of payment. 20 (e) The Commission shall ensure thatdetermine annually21the number of grants to be offered for study at each22degree-granting, not-for-profit private college or university23in this State, taking into consideration the amount of funds24available and past experience with the rate of grant funds25unclaimed by recipients.in each school year the total amount 26 of grants awarded under this Section for study at each 27 degree-granting, not-for-profit private college or university 28 in this State shall be at least equal to the total amount 29 deposited into the University Grant Fund from the issuance or 30 renewal of license plates bearing the name of that 31 degree-granting, not-for-profit private college or university 32 during the calendar year preceding the calendar year in which 33 the school year begins. 34 The institutionCommissionshall notify applicants that -4- LRB9002561THpkam 1 grant assistance is contingent upon the availability of 2 appropriated funds. 3 (Source: P.A. 89-424, eff. 6-1-96.) 4 Section 20. The Illinois Vehicle Code is amended by 5 changing Section 3-629 (as added by P.A. 89-424) as follows: 6 (625 ILCS 5/3-629) 7 Sec. 3-629. Collegiate license plates; scholarship fund. 8 (a) In addition to any other special license plate, the 9 Secretary, upon receipt of all applicable fees and 10 applications made in the form prescribed by the Secretary of 11 State, may issue collegiate license plates. The collegiate 12 plates issued under this Section shall be affixed only to 13 passenger vehicles of the first division and motor vehicles 14 of the second division weighing not more than 8,000 pounds 15 and subject to the staggered registration system. Plates 16 issued under this Section shall expire according to the 17 staggered multi-year procedure established under Section 18 3-414.1 of this Code. 19 (b) The design, color, and format of the plates shall be 20 wholly within the discretion of the Secretary of State. The 21 Secretary of State may, at his or her discretion, issue the 22 plates for any public or degree-granting, not-for-profit 23 private college or university located in this State. The 24 Secretary may, in his or her discretion, allow the plates to 25 be issued as vanity plates or personalized in accordance with 26 Section 3-405.1 of this Code. The plates are not required to 27 designate "Land Of Lincoln", as prescribed in subsection (b) 28 of Section 3-412 of this Code. The Secretary shall prescribe 29 the eligibility requirements including a minimum level of 30 specialized license plates requests and, in his or her 31 discretion, shall approve and prescribe stickers or decals as 32 provided under Section 3-412. -5- LRB9002561THpkam 1 (c) An applicant shall be charged a $40 fee for original 2 issuance in addition to the applicable registration fee. Of 3 the original issuance fee in the case of a public university 4 or college, $25 shall be deposited into the State College and 5 University Trust Fund and $15 shall be deposited into the 6 Secretary of State Special License Plate Fund to be used by 7 the Secretary of State, subject to appropriation, to help 8 defray the administrative costs of issuing the plate. Of the 9 original issuance fee in the case of a degree-granting, 10 not-for-profit private college or university, $25 shall be 11 deposited into the University Grant Fund and $15 shall be 12 deposited into the Secretary of State Special License Plate 13 Fund to be used by the Secretary of State, subject to 14 appropriation, to help defray the administrative cost of 15 issuing the plate. In addition to the regular renewal fee, 16 an applicant shall be charged $27 for the renewal of each set 17 of license plates issued under this Section; $25 shall be 18 deposited into the State College and University Trust Fund in 19 the case of a public university or college or into the 20 University Grant Fund in the case of a degree-granting, 21 not-for-profit private college or university, and $2 shall be 22 deposited into the Secretary of State Special License Plate 23 Fund plates for all collegiate plates. 24 (d) The State College and University Trust Fund is 25 created as a special fund in the State treasury. All moneys 26 in the State College and University Trust Fund shall be 27 distributed on January 1 of each year to each public 28 university or college in proportion to the number of plates 29 sold in regard to that university or college according to 30 subsection (c) for administration of the Higher Education 31 License Plate Grant program. Moneys deposited into the State 32 College and University Trust Fund shall be distributed to the 33 public university or college for the sole purpose of 34 scholarship grant awards. -6- LRB9002561THpkam 1 (e) The University Grant Fund is created as a special 2 fund in the State treasury. All moneys in the University 3 Grant Fund shall be appropriated to the Illinois Student 4 Assistance Commission to make reimbursements to participating 5 private colleges and universitiesgrantsunder the Higher 6 Education License Plate Grant Program. 7 (Source: P.A. 89-424, eff. 6-1-96; 89-626, eff. 8-9-96.)".
