110 ILCS 805/2-11.5
Amends the Public Community College Act and the Illinois
State University Law. Effective July 1, 1997, abolishes the
Illinois Institute for Entrepreneurship Education as created
and functioning within the Illinois Community College Board,
terminates the terms of its 18 member Board, and recreates
the Institute, as a successor to the predecessor Institute,
with a new 15 member Board within Illinois State University.
Provides for transfer of all powers, duties, records, and
property of the predecessor Institute to the successor
Institute as of July 1, 1997. Effective immediately.

1 AN ACT relating to higher education, amending named Acts.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 2. The Board of Higher Education Act is amended
5 by changing Section 4 as follows:
6 (110 ILCS 205/4) (from Ch. 144, par. 184)
7 Sec. 4. The Board shall hold regular meetings at times
8 specified in its rules. Special or additional meetings may
9 be held on call of the Chairman, or upon a call signed by at
10 least 6 members, or upon call of the Governor. A majority of
11 the members of the Board shall constitute a quorum at all its
12 meetings, but the approval of a new unit of instruction,
13 research, or public service for a public institution of
14 higher education, as provided in Section 7 shall require the
15 concurrence of a majority of all the members of the Board.
16 The Chairmen of the Illinois Community College Board and
17 the Illinois Student Assistance Commission holding membership
18 on the Board each may designate an alternate to attend any
19 meeting of the Board, and an alternate so designated shall
20 have all rights and privileges of regular membership while
21 acting for the Chairman who has so designated him or her.
22 The Board may employ and fix the compensation of
23 professional and clerical staff and other assistants,
24 including specialists and consultants, as it may deem
25 necessary, on a full or part time basis.

27 Section 5. The Illinois State University Law is amended
28 by adding Section 20-115 as follows:

1 Sec. 20-115. Illinois Institute for Entrepreneurship
2 Education.
3 (a) There is created, effective July 1, 1997, within the
4 State at Illinois State University, the Illinois Institute
5 for Entrepreneurship Education, hereinafter referred to as
6 the Institute.
7 (b) The Institute created under this Section shall
8 commence its operations on July 1, 1997 and shall have a
9 board composed of 15 members representative of education,
10 commerce and industry, government, or labor, appointed as
11 follows: 2 members shall be appointees of the Governor, one
12 of whom shall be a minority or female person as defined in
13 Section 2 of the Business Enterprise for Minorities, Females,
14 and Persons with Disabilities Act; one member shall be an
15 appointee of the President of the Senate; one member shall be
16 an appointee of the Minority Leader of the Senate; one
17 member shall be an appointee of the Speaker of the House of
18 Representatives; one member shall be an appointee of the
19 Minority Leader of the House of Representatives; 2 members
20 shall be appointees of Illinois State University; one member
21 shall be an appointee of the Board of Higher Education; one
22 member shall be an appointee of the State Board of Education;
23 one member shall be an appointee of the Department of
24 Commerce and Community Affairs; one member shall be an
25 appointee of the Illinois chapter of Economics America; and 3
26 members shall be appointed by majority vote of the other 12
27 appointed members to represent business owner-entrepreneurs.
28 Each member shall have expertise and experience in the area
29 of entrepreneurship education, including small business and
30 entrepreneurship. The majority of voting members must be
31 from the private sector. The members initially appointed to
32 the board of the Institute created under this Section shall
33 be appointed to take office on July 1, 1997 and shall by lot
34 determine the length of their respective terms as follows: 5

1 members shall be selected by lot to serve terms of one year,
2 5 members shall be selected by lot to serve terms of 2 years,
3 and 5 members shall be selected by lot to serve terms of 3
4 years. Subsequent appointees shall each serve terms of 3
5 years. The board shall annually select a chairperson from
6 among its members. Each board member shall serve without
7 compensation but shall be reimbursed for expenses incurred in
8 the performance of his or her duties.
9 (c) The purpose of the Institute shall be to foster the
10 growth and development of entrepreneurship education in the
11 State of Illinois. The Institute shall help remedy the
12 deficiencies in the preparation of entrepreneurship education
13 teachers, increase the quality and quantity of
14 entrepreneurship education programs, improve instructional
15 materials, and prepare personnel to serve as leaders and
16 consultants in the field of entrepreneurship education and
17 economic development. The Institute shall promote
18 entrepreneurship as a career option, promote and support the
19 development of innovative entrepreneurship education
20 materials and delivery systems, promote business, industry,
21 and education partnerships, promote collaboration and
22 involvement in entrepreneurship education programs, encourage
23 and support in-service and preservice teacher education
24 programs within various educational systems, and develop and
25 distribute relevant materials. The Institute shall provide a
26 framework under which the public and private sectors may work
27 together toward entrepreneurship education goals. These
28 goals shall be achieved by bringing together programs that
29 have an impact on entrepreneurship education to achieve
30 coordination among agencies and greater efficiency in the
31 expenditure of funds.
32 (d) Beginning July 1, 1997, the Institute shall have the
33 following powers subject to State and Illinois State
34 University Board of Trustees regulations and guidelines:

1 (1) To employ and determine the compensation of an
2 executive director and such staff as it deems necessary;
3 (2) To own property and expend and receive funds
4 and generate funds;
5 (3) To enter into agreements with public and
6 private entities in the furtherance of its purpose; and
7 (4) To request and receive the cooperation and
8 assistance of all State departments and agencies in the
9 furtherance of its purpose.
10 (e) The board of the Institute shall be a policy making
11 body with the responsibility for planning and developing
12 Institute programs. The Institute, through the Board of
13 Trustees of Illinois State University, shall annually report
14 to the Governor and General Assembly by January 31 as to its
15 activities and operations, including its findings and
16 recommendations.
17 (f) Beginning on July 1, 1997, the Institute created
18 under this Section shall be deemed designated by law as the
19 successor to the Illinois Institute for Entrepreneurship
20 Education, previously created and existing under Section
21 2-11.5 of the Public Community College Act until its
22 abolition on July 1, 1997 as provided in that Section. On
23 July 1, 1997, all financial and other records of the
24 Institute so abolished and all of its property, whether real
25 or personal, including but not limited to all inventory and
26 equipment, shall be deemed transferred by operation of law to
27 the Illinois Institute for Entrepreneurship Education created
28 under this Section 20-115. The Illinois Institute for
29 Entrepreneurship Education created under this Section 20-115
30 shall have, with respect to the predecessor Institute so
31 abolished, all authority, powers, and duties of a successor
32 agency under Section 10-15 of the Successor Agency Act.

33 equipment, shall be deemed transferred by operation of law to
34 the Illinois Institute for Entrepreneurship Education created

1 under this Section 2-11.5. The Illinois Institute for
2 Entrepreneurship Education created under this Section 2-11.5
3 shall have, with respect to the predecessor Institute so
4 abolished, all authority, powers, and duties of a successor
5 agency under Section 10-15 of the Successor Agency Act.
6 (g) The Institute created under this Section is
7 abolished on July 1, 1997, and the terms of the members of
8 the board of the Institute so abolished are terminated on
9 that date. All financial and other records of the Institute
10 so abolished and all of the property of that former
11 Institute, whether real or personal in nature, including but
12 not limited to all inventory and equipment, shall be deemed
13 transferred on July 1, 1997, by operation of law, to the
14 Illinois Institute for Entrepreneurship Education created
15 under Section 20-115 of the Illinois State University Law as
16 the successor of the Institute that is abolished as provided
17 in this Section 2-11.5.
18 (h) Subsections (a) through (f) of this Section 2-11.5
19 shall have no legal force or effect from and after July 1,
20 1997.
21 (i) This Section is repealed on July 31, 1997.

23 Section 99. Effective date. This Act takes effect upon
24 becoming law.
