 1                     AMENDMENT TO HOUSE BILL 674
 2        AMENDMENT NO.     .  Amend House Bill 674 on page  1,  by
 3    replacing lines 1 and 2 with the following:
 4        "AN ACT regarding the Department of Agriculture, amending
 5    named  Acts."; and
 6    on page 6, below line 33, by inserting the following:
 7        "Section  10.   The  Illinois  Diseased  Animals  Act  is
 8    amended by changing Sections 1, 3, 19, 22, and 24 as follows:
 9        (510 ILCS 50/1) (from Ch. 8, par. 168)
10        Sec. 1. For the purposes of this Act:
11        "Department"  means  the Department of Agriculture of the
12    State of Illinois.
13        "Director" means the Director of the Illinois  Department
14    of Agriculture, or his duly appointed representative.
15        "Contagious  or  infectious  disease"  means  a  specific
16    disease   designated  by  the  Department  as  contagious  or
17    infectious under rules pertaining to this Act.
18        "Reportable disease" means a specific disease  designated
19    by  the  Department  as  reportable under rules pertaining to
20    this Act.
21        "Infectious disease" means the  reaction  resulting  from

 1    the    introduction    into    the   body   of   a   specific
 2    disease-producing organism or its toxic product.
 3        "Contagious disease" means a specific infectious  disease
 4    which  is  readily  transmitted  from  host to host by direct
 5    contact or by means of an intermediate host.
 6        "Animals"  means  domestic  animals,  poultry,  and  wild
 7    animals in captivity.

10        Sec. 3. Upon its becoming known to  the  Department  that
11    any  animals  are  infected,  or suspected of being infected,
12    with any contagious or  infectious  disease,  the  Department
13    shall  have the authority to cause proper examination thereof
14    to be made;  and  if  such  disease  is  found  to  be  of  a
15    dangerously  contagious  or  dangerously  infectious  nature,
16    shall  order  such  diseased  animals  and  such as have been
17    exposed to such disease, and the premises in or on which they
18    are, or  have  recently  occupied,  to  be  quarantined.  The
19    Department may, in connection with any such quarantine, order
20    that  no  animal which has been or is so diseased, or exposed
21    to  such  disease,  may  be  removed  from  the  premises  so
22    quarantined and that no animal susceptible  to  such  disease
23    may be brought therein or thereon, except under such rules as
24    the Department may prescribe.

27        Sec.  19.  Any railroad, truck, steamboat, transportation
28    or stockyard company  violating  any  of  the  provisions  of
29    Section 18, or any of the rules of the Department referred to
30    therein,  shall  be guilty of a business offense and shall be
31    fined in any sum not exceeding one thousand dollars  ($1,000)
32    for each offense.

 3        Sec.  22.  Any  veterinarian  having  information  of the
 4    existence of any reportable contagious or infectious  disease
 5    among  animals  in  this  State, who fails to promptly report
 6    such knowledge to  the  Department,  shall  be  guilty  of  a
 7    business  offense and shall be fined in any sum not exceeding
 8    $1,000 for each offense Class A misdemeanor.

11        Sec. 24. Any owner or person having charge of any  animal
12    swine  and  having  knowledge  of,  or  reasonable grounds to
13    suspect the existence among them of,  the  disease  known  as
14    "hog  cholera,"  or  of  any  other  contagious or infectious
15    disease and who does not use reasonable means to prevent  the
16    spread  of  such  disease;  or  who conveys upon or along any
17    public highway or other public grounds or any private  lands,
18    any diseased animal swine, or animal swine known to have died
19    of,  or  been  slaughtered  on  account of, any contagious or
20    infectious disease, shall be liable in damages to the  person
21    or persons who may have suffered loss on account thereof.

23        Section  15.   The  Illinois  Swine  Disease  Control and
24    Eradication Act is amended by changing Section 3 as follows:
25        (510 ILCS 100/3) (from Ch. 8, par. 503)
26        Sec. 3.  It is the duty of the  owner  or  person  having
27    charge  of  any  swine  and having knowledge of or reasonable
28    grounds to suspect the existence  among  such  swine  of  any
29    contagious  or infectious disease, as defined in Section 1 of
30    the Illinois Diseased Animals  Act,  to  use  all  reasonable

 1    means  to  prevent  the  spread  of  the  disease.  When such
 2    knowledge comes to such person that any swine had died of, or
 3    had been slaughtered on account of any such  disease,  it  is
 4    such  person's  duty  to immediately dispose of such swine as
 5    provided in "An Act in  relation  to  the  disposal  of  dead
 6    animals",  approved  July  16,  1941,  as  now  or  hereafter
 7    amended.
