Amend House Bill 606 by replacing 3 the title with the following: 4 "AN ACT to amend the Illinois Horse Racing Act of 1975 by 5 changing Section 31.1."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The Illinois Horse Racing Act of 1975 is 9 amended by changing Section 31.1 as follows: 10 (230 ILCS 5/31.1) (from Ch. 8, par. 37-31.1) 11 Sec. 31.1. (a) Organization licensees collectively shall 12 contribute annually to charity the sum of $750,000 to 13 non-profit organizations that provide medical and family, 14 counseling, and similar services to persons who reside or 15 work on the backstretch of Illinois racetracks. These 16 contributions shall be collected as follows: (i) no later 17 than July 1st of each year the Board shall assess each 18 organization licensee,(except those tracks which are not 19 within 100 miles of each other and except any track that did 20 not conduct live racing during the previous year, which 21 tracks shall pay $30,000 annually apiece into the Board -2- LRB9001680LDdvam01 1 charity fund),that amount which equals $690,000 multiplied 2 by the amount of pari-mutuel wagering handled by the 3 organization licensee in the year preceding assessment and 4 divided by the total pari-mutuel wagering handled by all 5 Illinois organization licensees,(except those tracks which 6 are not within 100 miles of each other and except any track 7 that did not conduct live racing during the previous year),8 in the year preceding assessment; (ii) notice of the assessed 9 contribution shall be mailed to each organization licensee; 10 (iii) within thirty days of its receipt of such notice, each 11 organization licensee shall remit the assessed contribution 12 to the Board. If an organization licensee wilfully fails to 13 so remit the contribution, the Board may revoke its license 14 to conduct horse racing. 15 (b) No later than October 1st of each year, any 16 qualified charitable organization seeking an allotment of 17 contributed funds shall submit to the Board an application 18 for those funds, using the Board's approved form. No later 19 than December 31st of each year, the Board shall distribute 20 all such amounts collected that year to such charitable 21 organization applicants. 22 (Source: P.A. 87-110.) 23 Section 99. Effective date. This Act takes effect upon 24 becoming law.".
