LRB9001680LDdv HB0606 Engrossed LRB9001680LDdv 1 AN ACT to amend the Illinois Horse Racing Act of 1975 by 2 changing Section 31.1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Horse Racing Act of 1975 is 6 amended by changing Section 31.1 as follows: 7 (230 ILCS 5/31.1) (from Ch. 8, par. 37-31.1) 8 Sec. 31.1. (a) Organization licensees collectively shall 9 contribute annually to charity the sum of $750,000 to 10 non-profit organizations that provide medical and family, 11 counseling, and similar services to persons who reside or 12 work on the backstretch of Illinois racetracks. These 13 contributions shall be collected as follows: (i) no later 14 than July 1st of each year the Board shall assess each 15 organization licensee,(except those tracks which are not 16 within 100 miles of each other and except any track that did 17 not conduct live racing during the previous year, which 18 tracks shall pay $30,000 annually apiece into the Board 19 charity fund),that amount which equals $690,000 multiplied 20 by the amount of pari-mutuel wagering handled by the 21 organization licensee in the year preceding assessment and 22 divided by the total pari-mutuel wagering handled by all 23 Illinois organization licensees,(except those tracks which 24 are not within 100 miles of each other and except any track 25 that did not conduct live racing during the previous year),26 in the year preceding assessment; (ii) notice of the assessed 27 contribution shall be mailed to each organization licensee; 28 (iii) within thirty days of its receipt of such notice, each 29 organization licensee shall remit the assessed contribution 30 to the Board. If an organization licensee wilfully fails to 31 so remit the contribution, the Board may revoke its license HB0606 Engrossed -2- LRB9001680LDdv 1 to conduct horse racing. 2 (b) No later than October 1st of each year, any 3 qualified charitable organization seeking an allotment of 4 contributed funds shall submit to the Board an application 5 for those funds, using the Board's approved form. No later 6 than December 31st of each year, the Board shall distribute 7 all such amounts collected that year to such charitable 8 organization applicants. 9 (Source: P.A. 87-110.) 10 Section 99.
