Provides that it is unlawful to knowingly use or implant sperm, ova, or embryos in assisted reproduction technology without the written consent of the sperm, ova, or embryo provider and the recipient. Exempts from the consent requirements men who donate sperm to registered tissue banks. Penalty for a violation is a Class 3 felony. Effective immediately. LRB9001815RCks LRB9001815RCks 1 AN ACT to amend the Criminal Code of 1961 by adding 2 Section 17-22. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 adding Section 17-22 as follows: 7 (720 ILCS 5/17-22 new) 8 Sec. 17-22. Sperm donors and recipients. 9 (a) It is unlawful for anyone to knowingly use sperm, 10 ova, or embryos in assisted reproduction technology, for any 11 purpose other than that indicated by the sperm, ova or embryo 12 provider's signature on a written consent form. 13 (b) It is unlawful for anyone to knowingly implant 14 sperm, ova, or embryos, through the use of assisted 15 reproduction technology, into a recipient who is not the 16 sperm, ova, or embryo provider, without the signed written 17 consent of the sperm, ova, or embryo provider and recipient. 18 (c) Sentence. A person who violates this Section is 19 guilty of a Class 3 felony. 20 (d) Written consent is not required of men who donate 21 sperm to a tissue bank registered with the Department of 22 Public Health under Section 55.46 of the Civil Administrative 23 Code of Illinois. 24 Section 99. Effective date. This Act takes effect upon 25 becoming law.
