90_HB0351 New Act 15 ILCS 20/38.1 from Ch. 127, par. 38.1 Creates the Agency Appropriation Act. Requires separate legislative bills for appropriations to each State agency. Amends the Civil Administrative Code of Illinois. Provides that the Governor, in submitting the budget, and the General Assembly, in acting on the budget, shall employ performance-based budgeting concepts. Provides that this system of performance-based budgeting shall identify department outcomes and results and provide comprehensive information regarding actual and proposed changes in funding and outcomes. LRB9001831KRsb LRB9001831KRsb 1 AN ACT concerning appropriation bills. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Agency Appropriation Act. 6 Section 5. Separate appropriation bills. An 7 appropriation bill introduced in and passed by the General 8 Assembly shall contain appropriations to no more than one 9 State department, State agency, or other entity of State 10 government. Appropriations to each State department, State 11 agency, or other entity of State government shall be 12 contained in separate bills introduced in and passed by the 13 General Assembly. 14 Section 15. The Civil Administrative Code of Illinois is 15 amended by changing Section 38.1 as follows: 16 (15 ILCS 20/38.1) (from Ch. 127, par. 38.1) 17 (Text of Section before amendment by P.A. 89-507) 18 Sec. 38.1. The budget shall be submitted by the Governor 19 with line item and program data. The budget shall also 20 contain performance data presenting an estimate for the 21 current fiscal year, projections for the budget year and 22 information for the 3 prior fiscal years comparing department 23 objectives with actual accomplishments, formulated according 24 to the various functions and activities, and, wherever the 25 nature of the work admits, according to the work units, for 26 which the respective departments, offices and institutions of 27 the State government (including the elective officers in the 28 executive department and including the University of Illinois 29 and the judicial department) are responsible. For the fiscal -2- LRB9001831KRsb 1 year beginning July 1, 1992 and for each fiscal year 2 thereafter, the budget shall include the performance measures 3 of each department's accountability report. For the fiscal 4 year beginning July 1, 1996 and for each fiscal year 5 thereafter, the budget shall include one or more line items 6 appropriating moneys to the Department of Mental Health and 7 Developmental Disabilities to fund participation in the 8 Home-Based Support Services Program for Mentally Disabled 9 Adults under the Developmental Disability and Mental 10 Disability Services Act by persons described in Section 2-17 11 of that Act. The budget shall contain a capital development 12 Section in which the Governor will present (1) information on 13 the capital projects and capital programs for which 14 appropriations are requested and (2) the capital spending 15 plans, which shall document the first and subsequent years 16 cash requirements by fund for the proposed bonded program and 17 (3) a statement which shall identify by year the principal 18 and interest costs until retirement of the State's general 19 obligation debt. In addition, the principal and interest 20 costs of the budget year program shall be presented 21 separately, to indicate the marginal cost of principal and 22 interest payments necessary to retire the additional bonds 23 needed to finance the budget year's capital program. For the 24 budget year, the current year, and three prior fiscal years, 25 the Governor shall also include in the budget estimates of or 26 actual values for the assets and liabilities for General 27 Assembly Retirement System, State Employees' Retirement 28 System of Illinois, State Universities Retirement System, 29 Teachers' Retirement System of the State of Illinois, and 30 Judges Retirement System of Illinois. The budget submitted by 31 the Governor shall contain, in addition, in a separate book, 32 a tabulation of all position and employment titles in each 33 such department, office and institution, the number of each, 34 and the salaries for each, formulated according to divisions, -3- LRB9001831KRsb 1 bureaus, sections, offices, departments, boards, and similar 2 subdivisions, which shall correspond as nearly as practicable 3 to the functions and activities for which the department, 4 office or institution is responsible. Together with such 5 budget, the Governor shall transmit the estimates of receipts 6 and expenditures, as received by the director of the Bureau 7 of the Budget, of the elective officers in the executive and 8 judicial departments and of the University of Illinois. 9 (Source: P.A. 89-425, eff. 6-1-96.) 10 (Text of Section after amendment by P.A. 89-507) 11 Sec. 38.1. The budget shall be submitted by the Governor 12 with line item and program data. For the fiscal 26 year beginning July 1, 1997 and for each fiscal year 27 thereafter, the budget shall include one or more line items 28 appropriating moneys to the Department of Human Services to 29 fund participation in the Home-Based Support Services Program 30 for Mentally Disabled Adults under the Developmental 31 Disability and Mental Disability Services Act by persons 32 described in Section 2-17 of that Act. The budget shall 33 contain a capital development Section in which the Governor 34 will present (1) information on the capital projects and -4- LRB9001831KRsb 1 capital programs for which appropriations are requested and 2 (2) the capital spending plans, which shall document the 3 first and subsequent years cash requirements by fund for the 4 proposed bonded program and (3) a statement which shall 5 identify by year the principal and interest costs until 6 retirement of the State's general obligation debt. In 7 addition, the principal and interest costs of the budget year 8 program shall be presented separately, to indicate the 9 marginal cost of principal and interest payments necessary to 10 retire the additional bonds needed to finance the budget 11 year's capital program. For the budget year, the current 12 year, and three prior fiscal years, the Governor shall also 13 include in the budget estimates of or actual values for the 14 assets and liabilities for General Assembly Retirement 15 System, State Employees' Retirement System of Illinois, State 16 Universities Retirement System, Teachers' Retirement System 17 of the State of Illinois, and Judges Retirement System of 18 Illinois. The budget submitted by the Governor shall contain, 19 in addition, in a separate book, a tabulation of all position 20 and employment titles in each such department, office and 21 institution, the number of each, and the salaries for each, 22 formulated according to divisions, bureaus, sections, 23 offices, departments, boards, and similar subdivisions, which 24 shall correspond as nearly as practicable to the functions 25 and activities for which the department, office or 26 institution is responsible. Together with such budget, the 27 Governor shall transmit the estimates of receipts and 28 expenditures, as received by the director of the Bureau of 29 the Budget, of the elective officers in the executive and 30 judicial departments and of the University of Illinois. 31 Notwithstanding any other provision of law, the Governor, 32 in submitting the budget, and the General Assembly, in acting 33 on the budget, shall employ performance-based budgeting 34 concepts. For purposes of this Section, "performance based -5- LRB9001831KRsb 1 budgeting" means a budget system that identifies department 2 outcomes and results and provides comprehensive information 3 regarding actual and proposed changes in funding and 4 outcomes. 5 (Source: P.A. 89-425, eff. 6-1-96; 89-507, eff. 7-1-97.) 6 Section 95. No acceleration or delay. Where this Act 7 makes changes in a statute that is represented in this Act by 8 text that is not yet or no longer in effect (for example, a 9 Section represented by multiple versions), the use of that 10 text does not accelerate or delay the taking effect of (i) 11 the changes made by this Act or (ii) provisions derived from 12 any other Public Act.
