6 To the President of the Senate and the Speaker of the
7 House of Representatives:
8 We, the conference committee appointed to consider the
9 differences between the houses in relation to Senate
10 Amendment No. 3 to House Bill 297, recommend the following:
11 (1) that the Senate recede from Senate Amendment No. 3;
12 and
13 (2) that House Bill 297, AS AMENDED by Senate Amendment
14 No. 1, be further amended with reference to page and line
15 numbers of Senate Amendment No. 1, on page 2, line 22, before
16 "means", by inserting "either"; and
17 on page 2, line 23, by replacing "society", with "society,
18 but not both,"; and
19 on page 2, line 25, after the period, by inserting the
20 following:
21 ""Loss of society" means the mutual benefits that each family
22 member receives from the other's continued existence,
23 including love, affection, care, attention, companionship,
24 comfort, guidance, and protection. "Family" includes spouse,
25 children, parents, brothers, and sisters."; and
26 on page 3, lines 27 and 34, by replacing "January", each time
27 it appears, with "July"; and
28 on page 4, line 2, by replacing "$55,000" with "$45,000"; and
29 on page 4, line 3, before "loss", by inserting "either"; and
30 on page 4, line 4, before "resulting", by inserting "or loss
31 of society"; and

1 on page 4, line 5, by replacing "$65,000. Recovery under
2 this Act for" with "$55,000."; and
3 on page 4, by replacing lines 6 and 7 with the following:
4 "Beginning in 1999, every January 20, these liability limits
5 shall automatically be increased or decreased, as applicable,
6 by a percentage equal to the percentage change in the
7 consumer price index-u during the preceding 12-month calendar
8 year. "Consumer price index-u" means the index published by
9 the Bureau of Labor Statistics of the United States
10 Department of Labor that measures the average change in
11 prices of goods and services purchased by all urban
12 consumers, United States city average, all items, 1982-84 =
13 100. The new amount resulting from each annual adjustment
14 shall be determined by the Comptroller and made available to
15 the chief judge of each judicial circuit. The liability
16 limits at the time at which damages subject to such limits
17 are awarded by final judgment or settlement shall be utilized
18 by the courts.".
