1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Forest Preserve Zoological Parks Act is
5 amended by changing Section 2 as follows:
 
6     (70 ILCS 835/2)  (from Ch. 96 1/2, par. 6802)
7     Sec. 2. Zoological park; tax.
8     (a) For the purpose of constructing and maintaining and
9 caring for any such zoological park and the buildings and
10 grounds thereof and of securing and displaying zoological
11 collections thereon the corporate authorities of any forest
12 preserve district containing a population of 150,000 or more
13 but less than 3,000,000 are authorized to levy annually a tax
14 of not to exceed .0058% of value as equalized or assessed by
15 the Department of Revenue, upon all the taxable property in the
16 district. ; provided however, in
17     (b) In a forest preserve district located in a county with
18 a population in excess of 140,000 but less than 200,000 and
19 contiguous to the Mississippi River, however, the annual tax
20 may be at a rate not to exceed 0.06% .01%.
21     (c) This tax shall be levied and collected in the same
22 manner as the general taxes of the forest preserve district and
23 shall be in addition to the maximum of all other taxes and tax

1 rates which the district is now or may hereafter be authorized
2 to levy upon the aggregate valuation of all taxable property
3 within the district and shall be exclusive of and in addition
4 to the maximum amount and rate of taxes the district is now or
5 may hereafter be authorized to levy for general purposes under
6 Section 13 of the Downstate Forest Preserve District Act "An
7 Act to provide for the creation and management of forest
8 preserve districts and repealing certain Acts therein named",
9 approved June 27, 1913, as amended, or under any other law
10 which may limit the amount of tax which the district may levy
11 for general purposes. The proceeds of the tax herein authorized
12 shall be kept as a separate fund.
13     (d) A tax in excess of 0.01% may not be levied under
14 subsection (b) until the question of levying the tax has been
15 submitted to the electors of the forest preserve district at a
16 regular election and approved by a majority of the electors
17 voting on the question. The District must certify the question
18 to the proper election authority, which must submit the
19 question at an election in accordance with the Election Code.
20     The election authority must submit the question in
21 substantially the following form:
22         Shall the corporate authority of the forest preserve
23     district be authorized to levy a tax at the rate of 0.06%
24     for the purpose of constructing and maintaining and caring
25     for any such zoological park and the buildings and grounds
26     thereof and of securing and displaying zoological

1     collections thereon?
2     The election authority must record the votes as "Yes" or
3 "No".
4     If a majority of the electors voting on the question vote
5 in the affirmative, the county may thereafter levy the tax.

7     Section 10. The Park District Aquarium and Museum Act is
8 amended by changing Section 2 as follows:

10     Sec. 2. Maintenance tax - Limitations - Levy and
11 collection. Each board of park commissioners, having control of
12 a public park or parks within which there shall be maintained
13 any aquarium or any museum or museums of art, industry, science
14 or natural or other history under the provisions of this Act,
15 is hereby authorized, subject to the provisions of Section 4 of
16 this Act, to levy annually a tax not to exceed .03 per cent in
17 park districts of less than 500,000 population and in districts
18 of over 500,000 population not to exceed .15 percent of the
19 full, fair cash value, as equalized or assessed by the
20 Department of Revenue of taxable property embraced in said
21 district, according to the valuation of the same as made for
22 the purpose of State and county taxation by the general
23 assessment last preceding the time when such tax hereby
24 authorized shall be levied: Such tax to be for the purpose of

1 establishing, acquiring, completing, erecting, enlarging,
2 ornamenting, building, rebuilding, rehabilitating, improving,
3 operating, maintaining and caring for such aquarium and museum
4 or museums and the buildings and grounds thereof; and the
5 proceeds of such additional tax shall be kept as a separate
6 fund. Said tax shall be in addition to all other taxes which
7 such board of park commissioners is now or hereafter may be
8 authorized to levy on the aggregate valuation of all taxable
9 property within the park district. Said tax shall be levied and
10 collected in like manner as the general taxes for such parks
11 and shall not be included within any limitation of rate for
12 general park purposes as now or hereafter provided by law but
13 shall be excluded therefrom and be in addition thereto and in
14 excess thereof. Provided, further, that the foregoing
15 limitations upon tax rates, insofar as they are applicable to
16 park districts of less than 500,000 population, may be further
17 increased or decreased according to the referendum provisions
18 of the General Revenue Law of Illinois.
19     Whenever the board of park commissioners of a park district
20 of less than 500,000 population adopts a resolution that it
21 shall levy and collect a tax for the purposes specified in this
22 Section in excess of .03 percent but not to exceed .07 percent
23 of the value of taxable property in the district, the board
24 shall cause the resolution to be published at least once in a
25 newspaper of general circulation within the district. If there
26 is no such newspaper, the resolution shall be posted in at

1 least 3 public places within the district. The publication or
2 posting of the resolution shall include a notice of (1) the
3 specific number of electors required to sign a petition
4 requesting that the question of the adoption of the resolution
5 be submitted to the electors of the district; (2) the time
6 within which the petition must be filed; and (3) the date of
7 the prospective referendum.
8     The secretary of the park district shall provide a petition
9 form to any individual requesting one.
10     Any taxpayer in such district may, within 30 days after the
11 first publication or posting of the resolution, file with the
12 secretary of the park district a petition signed by not less
13 than 10 percent or 1,500, whichever is lesser, of the electors
14 of the district requesting that the following question be
15 submitted to the electors of the district:
16     "Shall the .... Park District be authorized to levy an
17 annual tax in excess of .... but not to exceed .... as
18 authorized in Section 2 of "An Act concerning aquariums and
19 museums in public parks" for the purpose of establishing,
20 acquiring, completing, erecting, enlarging, ornamenting,
21 building, rebuilding, rehabilitating, improving, operating,
22 maintaining and caring for such aquariums and museum or museums
23 and the buildings and grounds thereof?" The secretary of the
24 park district shall certify the proposition to the proper
25 election authorities for submission to the electorate at a
26 regular scheduled election in accordance with the general

1 election law. If a majority of the electors voting on the
2 proposition vote in favor thereof, such increased tax shall
3 thereafter be authorized; if a majority of the vote is against
4 such proposition, the previous maximum rate shall remain in
5 effect until changed by law.
6     Whenever the board of park commissioners of a park district
7 of a population less than 500,000 adopts a resolution that it
8 shall levy and collect a tax for the purposes specified in this
9 Section in excess of 0.07% but not to exceed 0.15% of the value
10 of taxable property in the district, the board shall cause the
11 resolution to be published, at least once, in a newspaper of
12 general circulation within the district. If there is no such
13 newspaper, the resolution shall be posted in at least 3 public
14 places within the district. A tax in excess of 0.07% may not be
15 levied under this subsection until the question of levying the
16 tax has been submitted to the electors of the park district at
17 a regular election and approved by a majority of the electors
18 voting on the question. The District must certify the question
19 to the proper election authority, which must submit the
20 question at an election in accordance with the Election Code.
21 The election authority must submit the question in

24     annual tax in excess of .... but not to exceed .... as
25     authorized in Section 2 of "An Act concerning aquariums and

2     building, rebuilding, rehabilitating, improving,
3     operating, maintaining and caring for such aquariums and
4     museum or museums and the buildings and grounds thereof?".
5     If a majority of the electors voting on the proposition
6 vote in favor thereof, such increased tax shall thereafter be
7 authorized. If a majority of the electors vote against the
8 proposition, the previous maximum rate shall remain in effect
9 until changed by law.
