AMENDMENT TO HOUSE BILL 405

2     AMENDMENT NO. ______. Amend House Bill 405 on page 3,
3 immediately below line 6, by inserting the following:
 
4     "Section 10. The Park District Aquarium and Museum Act is
5 amended by changing Section 2 as follows:
 
6     (70 ILCS 1290/2)  (from Ch. 105, par. 327)
7     Sec. 2. Maintenance tax - Limitations - Levy and
8 collection. Each board of park commissioners, having control of
9 a public park or parks within which there shall be maintained
10 any aquarium or any museum or museums of art, industry, science
11 or natural or other history under the provisions of this Act,
12 is hereby authorized, subject to the provisions of Section 4 of
13 this Act, to levy annually a tax not to exceed .03 per cent in
14 park districts of less than 500,000 population and in districts
15 of over 500,000 population not to exceed .15 percent of the
16 full, fair cash value, as equalized or assessed by the

1 Department of Revenue of taxable property embraced in said
2 district, according to the valuation of the same as made for
3 the purpose of State and county taxation by the general
4 assessment last preceding the time when such tax hereby
5 authorized shall be levied: Such tax to be for the purpose of
6 establishing, acquiring, completing, erecting, enlarging,
7 ornamenting, building, rebuilding, rehabilitating, improving,
8 operating, maintaining and caring for such aquarium and museum
9 or museums and the buildings and grounds thereof; and the
10 proceeds of such additional tax shall be kept as a separate
11 fund. Said tax shall be in addition to all other taxes which
12 such board of park commissioners is now or hereafter may be
13 authorized to levy on the aggregate valuation of all taxable
14 property within the park district. Said tax shall be levied and
15 collected in like manner as the general taxes for such parks
16 and shall not be included within any limitation of rate for
17 general park purposes as now or hereafter provided by law but
18 shall be excluded therefrom and be in addition thereto and in
19 excess thereof. Provided, further, that the foregoing
20 limitations upon tax rates, insofar as they are applicable to
21 park districts of less than 500,000 population, may be further
22 increased or decreased according to the referendum provisions
23 of the General Revenue Law of Illinois.
24     Whenever the board of park commissioners of a park district
25 of less than 500,000 population adopts a resolution that it
26 shall levy and collect a tax for the purposes specified in this

1 Section in excess of .03 percent but not to exceed .07 percent
2 of the value of taxable property in the district, the board
3 shall cause the resolution to be published at least once in a
4 newspaper of general circulation within the district. If there
5 is no such newspaper, the resolution shall be posted in at
6 least 3 public places within the district. The publication or
7 posting of the resolution shall include a notice of (1) the
8 specific number of electors required to sign a petition
9 requesting that the question of the adoption of the resolution
10 be submitted to the electors of the district; (2) the time
11 within which the petition must be filed; and (3) the date of
12 the prospective referendum.
13     The secretary of the park district shall provide a petition
14 form to any individual requesting one.
15     Any taxpayer in such district may, within 30 days after the
16 first publication or posting of the resolution, file with the
17 secretary of the park district a petition signed by not less
18 than 10 percent or 1,500, whichever is lesser, of the electors
19 of the district requesting that the following question be
20 submitted to the electors of the district:
21     "Shall the .... Park District be authorized to levy an
22 annual tax in excess of .... but not to exceed .... as
23 authorized in Section 2 of "An Act concerning aquariums and
24 museums in public parks" for the purpose of establishing,
25 acquiring, completing, erecting, enlarging, ornamenting,
26 building, rebuilding, rehabilitating, improving, operating,

1 maintaining and caring for such aquariums and museum or museums
2 and the buildings and grounds thereof?" The secretary of the
3 park district shall certify the proposition to the proper
4 election authorities for submission to the electorate at a
5 regular scheduled election in accordance with the general
6 election law. If a majority of the electors voting on the
7 proposition vote in favor thereof, such increased tax shall
8 thereafter be authorized; if a majority of the vote is against
9 such proposition, the previous maximum rate shall remain in
10 effect until changed by law.
11     Whenever the board of park commissioners of a park district
12 of a population less than 500,000 adopts a resolution that it
13 shall levy and collect a tax for the purposes specified in this
14 Section in excess of 0.07% but not to exceed 0.15% of the value
15 of taxable property in the district, the board shall cause the
16 resolution to be published, at least once, in a newspaper of
17 general circulation within the district. If there is no such
18 newspaper, the resolution shall be posted in at least 3 public
19 places within the district. A tax in excess of 0.07% may not be
20 levied under this subsection until the question of levying the
21 tax has been submitted to the electors of the park district at
22 a regular election and approved by a majority of the electors
23 voting on the question. The District must certify the question
24 to the proper election authority, which must submit the
25 question at an election in accordance with the Election Code.
