| 2 | | AMENDMENT NO. ______. Amend Senate Bill 3261 by replacing | 3 | | everything after the enacting clause with the following: | 4 | | "Section 5. The School Code is amended by changing Section | 5 | | 10-22.39 and by adding Section 34-18.85 as follows: | 6 | | (105 ILCS 5/10-22.39) | 7 | | (Text of Section before amendment by P.A. 103-41 and P.A. | 8 | | 103-542 ) | 9 | | Sec. 10-22.39. In-service training programs. | 10 | | (a) To conduct in-service training programs for teachers. | 11 | | (b) In addition to other topics at in-service training | 12 | | programs, at least once every 2 years, licensed school | 13 | | personnel and administrators who work with pupils in | 14 | | kindergarten through grade 12 shall be trained to identify the | 15 | | warning signs of mental illness, trauma, and suicidal behavior | 16 | | in youth and shall be taught appropriate intervention and |

A school district may utilize the | 2 | | Illinois Mental Health First Aid training program, established | 3 | | under the Illinois Mental Health First Aid Training Act and | 4 | | administered by certified instructors trained by a national | 5 | | association recognized as an authority in behavioral health, | 6 | | to provide the training and meet the requirements under this | 7 | | subsection. If licensed school personnel or an administrator | 8 | | obtains mental health first aid training outside of an | 9 | | in-service training program, he or she may present a | 10 | | certificate of successful completion of the training to the | 11 | | school district to satisfy the requirements of this | 12 | | subsection. | 13 | | Training regarding the implementation of trauma-informed | 14 | | practices satisfies the requirements of this subsection (b). | 15 | | A course of instruction as described in this subsection | 16 | | (b) must include the definitions of trauma, trauma-responsive | 17 | | learning environments, and whole child set forth in subsection | 18 | | (b) of Section 3-11 of this Code and may provide information | 19 | | that is relevant to and within the scope of the duties of | 20 | | licensed school personnel or school administrators. Such | 21 | | information may include, but is not limited to: | 22 | | (1) the recognition of and care for trauma in students | 23 | | and staff; | 24 | | (2) the relationship between educator wellness and | 25 | | student learning; | 26 | | (3) the effect of trauma on student behavior and |

| 1 | | learning; | 2 | | (4) the prevalence of trauma among students, including | 3 | | the prevalence of trauma among student populations at | 4 | | higher risk of experiencing trauma; | 5 | | (5) the effects of implicit or explicit bias on | 6 | | recognizing trauma among various student groups in | 7 | | connection with race, ethnicity, gender identity, sexual | 8 | | orientation, socio-economic status, and other relevant | 9 | | factors; and | 10 | | (6) effective district practices that are shown to: | 11 | | (A) prevent and mitigate the negative effect of | 12 | | trauma on student behavior and learning; and | 13 | | (B) support the emotional wellness of staff. | 14 | | (c) School counselors, nurses, teachers and other school | 15 | | personnel who work with pupils may be trained to have a basic | 16 | | knowledge of matters relating to acquired immunodeficiency | 17 | | syndrome (AIDS), including the nature of the disease, its | 18 | | causes and effects, the means of detecting it and preventing | 19 | | its transmission, and the availability of appropriate sources | 20 | | of counseling and referral, and any other information that may | 21 | | be appropriate considering the age and grade level of such | 22 | | pupils. The School Board shall supervise such training. The | 23 | | State Board of Education and the Department of Public Health | 24 | | shall jointly develop standards for such training. | 25 | | (d) In this subsection (d): | 26 | | "Domestic violence" means abuse by a family or household |

| 1 | | member, as "abuse" and "family or household members" are | 2 | | defined in Section 103 of the Illinois Domestic Violence Act | 3 | | of 1986. | 4 | | "Sexual violence" means sexual assault, abuse, or stalking | 5 | | of an adult or minor child proscribed in the Criminal Code of | 6 | | 1961 or the Criminal Code of 2012 in Sections 11-1.20, | 7 | | 11-1.30, 11-1.40, 11-1.50, 11-1.60, 12-7.3, 12-7.4, 12-7.5, | 8 | | 12-12, 12-13, 12-14, 12-14.1, 12-15, and 12-16, including | 9 | | sexual violence committed by perpetrators who are strangers to | 10 | | the victim and sexual violence committed by perpetrators who | 11 | | are known or related by blood or marriage to the victim. | 12 | | At least once every 2 years, an in-service training | 13 | | program for school personnel who work with pupils, including, | 14 | | but not limited to, school and school district administrators, | 15 | | teachers, school social workers, school counselors, school | 16 | | psychologists, and school nurses, must be conducted by persons | 17 | | with expertise in domestic and sexual violence and the needs | 18 | | of expectant and parenting youth and shall include training | 19 | | concerning (i) communicating with and listening to youth | 20 | | victims of domestic or sexual violence and expectant and | 21 | | parenting youth, (ii) connecting youth victims of domestic or | 22 | | sexual violence and expectant and parenting youth to | 23 | | appropriate in-school services and other agencies, programs, | 24 | | and services as needed, and (iii) implementing the school | 25 | | district's policies, procedures, and protocols with regard to | 26 | | such youth, including confidentiality. | 1 | | personnel must be trained to understand, provide information | 2 | | and referrals, and address issues pertaining to youth who are | 3 | | parents, expectant parents, or victims of domestic or sexual | 4 | | violence. | 5 | | (e) At least every 2 years, an in-service training program | 6 | | for school personnel who work with pupils must be conducted by | 7 | | persons with expertise in anaphylactic reactions and | 8 | | management. | 9 | | (f) At least once every 2 years, a school board shall | 10 | | conduct in-service training on educator ethics, | 11 | | teacher-student conduct, and school employee-student conduct | 12 | | for all personnel. | 13 | | (g) At least once every 2 years, a school board shall | 14 | | conduct in-service training for all school district employees | 15 | | on the methods to respond to trauma. The training must include | 16 | | instruction on how to respond to an incident involving | 17 | | life-threatening bleeding and, if applicable, how to use a | 18 | | school's trauma kit. A school board may satisfy the training | 19 | | requirements under this subsection by using the training, | 20 | | including online training, available from the American College | 21 | | of Surgeons or any other similar organization. | 22 | | School district employees who are trained to respond to | 23 | | trauma pursuant to this subsection (g) shall be immune from | 24 | | civil liability in the use of a trauma kit unless the action | 25 | | constitutes willful or wanton misconduct. | 26 | | (i) Beginning with the 2024-2025 school year, at least |

| 1 | | renewal as outlined in subsection (e) of Section 21B-45. | 2 | | School support personnel may be exempt from in-service | 3 | | training if the training is not relevant to the work they do. | 4 | | Nurses and school nurses, as defined by Section 10-22.23, | 5 | | are exempt from training required in subsection (b-5). | 6 | | Beginning July 1, 2024, all teachers, administrators, and | 7 | | school support personnel shall complete training as outlined | 8 | | in Section 10-22.39 during an in-service training program | 9 | | conducted by their school board or through other training | 10 | | opportunities, including, but not limited to, institutes under | 11 | | Section 3-11. Such training must be completed within 6 months | 12 | | of employment by a school board and renewed at least once every | 13 | | 5 years, unless required more frequently by other State or | 14 | | federal law or in accordance with this Section. If teachers, | 15 | | administrators, or school support personnel obtain training | 16 | | outside of an in-service training program or from a previous | 17 | | public school district or nonpublic school employer, they may | 18 | | present documentation showing current compliance with this | 19 | | subsection to satisfy the requirement of receiving training | 20 | | within 6 months of first being employed. Training may be | 21 | | delivered through online, asynchronous means. | 22 | | (b-5) Training regarding health conditions of students for | 23 | | staff required by this Section shall include, but is not | 24 | | limited to: | 25 | | (1) Chronic health conditions of students. | 26 | | (2) Anaphylactic reactions and management. Such |

| 1 | | training shall be conducted by persons with expertise in | 2 | | anaphylactic reactions and management. | 3 | | (3) The management of asthma, the prevention of asthma | 4 | | symptoms, and emergency response in the school setting. | 5 | | (4) The basics of seizure recognition and first aid | 6 | | and appropriate emergency protocols. Such training must be | 7 | | fully consistent with the best practice guidelines issued | 8 | | by the Centers for Disease Control and Prevention. | 9 | | (5) The basics of diabetes care, how to identify when | 10 | | a student with diabetes needs immediate or emergency | 11 | | medical attention, and whom to contact in the case of an | 12 | | emergency. | 13 | | (6) Current best practices regarding the | 14 | | identification and treatment of attention deficit | 15 | | hyperactivity disorder. | 16 | | (7) Instruction on how to respond to an incident | 17 | | involving life-threatening bleeding and, if applicable, | 18 | | how to use a school's trauma kit. Beginning with the | 19 | | 2024-2025 school year, training on life-threatening | 20 | | bleeding must be completed within 6 months of the employee | 21 | | first being employed by a school board and renewed within | 22 | | 2 years. Beginning with the 2027-2028 school year, the | 23 | | training must be completed within 6 months of the employee | 24 | | first being employed by a school board and renewed at | 25 | | least once every 5 years thereafter. | 26 | | In consultation with professional organizations with |

| 1 | | expertise in student health issues, including, but not limited | 2 | | to, asthma management, anaphylactic reactions, seizure | 3 | | recognition, and diabetes care, the State Board of Education | 4 | | shall make available resource materials for educating school | 5 | | personnel about student health conditions and emergency | 6 | | response in the school setting. | 7 | | A school board may satisfy the life-threatening bleeding | 8 | | training under this subsection by using the training, | 9 | | including online training, available from the American College | 10 | | of Surgeons or any other similar organization. | 11 | | (b-10) The training regarding social-emotional learning , | 12 | | for staff required by this Section may include, at a minimum, | 13 | | providing education to all school personnel about the content | 14 | | of the Illinois Social and Emotional Learning Standards, how | 15 | | those standards apply to everyday school interactions, and | 16 | | examples of how social emotional learning can be integrated | 17 | | into instructional practices across all grades and subjects. | 18 | | (b-15) The training regarding developing cultural | 19 | | competency for staff required by this Section shall include, | 20 | | but is not limited to, understanding and reducing implicit | 21 | | bias, including implicit racial bias. As used in this | 22 | | subsection, "implicit racial bias" has the meaning set forth | 23 | | in Section 10-20.61. | 24 | | (b-20) The training regarding identifying warning signs of | 25 | | mental illness, trauma, and suicidal behavior in youth for | 26 | | staff required by this Section shall include, but is not |

| 1 | | Comprehensive Health Education Act. | 2 | | (b-30) The training regarding protections and | 3 | | accommodations for students shall include, but is not limited | 4 | | to, instruction on the federal Americans with Disabilities | 5 | | Act, as it pertains to the school environment, and | 6 | | homelessness. Beginning with the 2024-2025 school year, | 7 | | training on homelessness must be completed within 6 months of | 8 | | an employee first being employed by a school board and renewed | 9 | | within 2 years. Beginning with the 2027-2028 school year, the | 10 | | training must be completed within 6 months of the employee | 11 | | first being employed by a school board and renewed at least | 12 | | once every 5 years thereafter. Training on homelessness shall | 13 | | include the following: | 14 | | (1) the definition of homeless children and youths | 15 | | under 42 U.S.C. 11434a; | 16 | | (2) the signs of homelessness and housing insecurity; | 17 | | (3) the rights of students experiencing homelessness | 18 | | under State and federal law; | 19 | | (4) the steps to take when a homeless or | 20 | | housing-insecure student is identified; and | 21 | | (5) the appropriate referral techniques, including the | 22 | | name and contact number of the school or school district | 23 | | homeless liaison. | 24 | | School boards may work with a community-based organization | 25 | | that specializes in working with homeless children and youth | 26 | | to develop and provide the training. |

| 1 | | (b-35) The training regarding educator ethics and | 2 | | responding to child sexual abuse and grooming behavior shall | 3 | | include, but is not limited to, teacher-student conduct, | 4 | | school employee-student conduct, and evidence-informed | 5 | | training on preventing, recognizing, reporting, and responding | 6 | | to child sexual abuse and grooming as outlined in Section | 7 | | 10-23.13. | 8 | | (b-40) The training regarding effective instruction in | 9 | | violence prevention and conflict resolution required by this | 10 | | Section shall be conducted in accordance with the requirements | 11 | | of Section 27-23.4. | 12 | | (b-45) (c) Beginning July 1, 2024, all nonpublic | 13 | | elementary and secondary school teachers, administrators, and | 14 | | school support personnel shall complete the training set forth | 15 | | in subsection (b-5). If nonpublic | 19 | | teachers, administrators, or school support personnel obtain | 20 | | training from a public school district or nonpublic school | 21 | | employer, the teacher, administrator, or school support | 22 | | personnel may present documentation to the nonpublic school | 23 | | showing current compliance with this subsection to satisfy the | 24 | | requirement of receiving training within 6 months of first | 25 | | being employed. must include the definitions of trauma, | 26 | | trauma-responsive learning environments, and whole child set |

As used in this | 15 | | subsection, "implicit racial bias" has the meaning set forth | 16 | | in Section 10-20.61. | 17 | | (b-20) The training regarding identifying warning signs of | 18 | | mental illness, trauma, and suicidal behavior in youth for | 19 | | staff required by this Section shall include, but is not | 20 | | limited to, appropriate intervention and referral techniques, | 21 | | including resources and guidelines as outlined in Section | 22 | | 2-3.166 , and must include the definitions of trauma, | 23 | | trauma-responsive learning environments, and whole child set | 24 | | forth in subsection (b) of Section 3-11 of this Code . | 25 | | Illinois Mental Health First Aid training, established | 26 | | under the Illinois Mental Health First Aid Training Act, may |

Training | 7 | | regarding the implementation of trauma-informed practices | 8 | | satisfies the requirements of this subsection. | 9 | | (b-25) As used in this subsection: | 10 | | "Domestic violence" means abuse by a family or household | 11 | | member, as "abuse" and "family or household members" are | 12 | | defined in Section 103 of the Illinois Domestic Violence Act | 13 | | of 1986. | 14 | | "Sexual violence" means sexual assault, abuse, or stalking | 15 | | of an adult or minor child proscribed in the Criminal Code of | 16 | | 1961 or in Sections 11-1.20, 11-1.30, 11-1.40, 11-1.50, | 17 | | 11-1.60, 12-7.3, 12-7.4, 12-7.5, 12-12, 12-13, 12-14, 12-14.1, | 18 | | 12-15, and 12-16 of the Criminal Code of 2012, including | 19 | | sexual violence committed by perpetrators who are strangers to | 20 | | the victim and sexual violence committed by perpetrators who | 21 | | are known or related by blood or marriage to the victim. | 22 | | The training regarding domestic and sexual violence and | 23 | | the needs of expectant and parenting youth for staff required | 24 | | by this Section must be conducted by persons with expertise in | 25 | | domestic and sexual violence and the needs of expectant and | 26 | | parenting youth, and shall include, but is not limited to: |

| 1 | | (1) communicating with and listening to youth victims | 2 | | of domestic or sexual violence and expectant and parenting | 3 | | youth; | 4 | | (2) connecting youth victims of domestic or sexual | 5 | | violence and expectant and parenting youth to appropriate | 6 | | in-school services and other agencies, programs, and | 7 | | services as needed; | 8 | | (3) implementing the school district's policies, | 9 | | procedures, and protocols with regard to such youth, | 10 | | including confidentiality ; at . At a minimum, school | 11 | | personnel must be trained to understand, provide | 12 | | information and referrals, and address issues pertaining | 13 | | to youth who are parents, expectant parents, or victims of | 14 | | domestic or sexual violence; and | 15 | | (4) procedures for responding to incidents of teen | 16 | | dating violence that take place at the school, on school | 17 | | grounds, at school-sponsored activities, or in vehicles | 18 | | used for school-provided transportation as outlined in | 19 | | Section 3.10 of the Critical Health Problems and | 20 | | Comprehensive Health Education Act. | 21 | | (b-30) The training regarding protections and | 22 | | accommodations for students shall include, but is not limited | 23 | | to, instruction on the federal Americans with Disabilities | 24 | | Act, as it pertains to the school environment, and | 25 | | homelessness. Beginning with the 2024-2025 school year, | 26 | | training on homelessness must be completed within 6 months of |

Training on homelessness shall | 6 | | include the following: | 7 | | (1) the definition of homeless children and youths | 8 | | under 42 U.S.C. 11434a; | 9 | | (2) the signs of homelessness and housing insecurity; | 10 | | (3) the rights of students experiencing homelessness | 11 | | under State and federal law; | 12 | | (4) the steps to take when a homeless or | 13 | | housing-insecure student is identified; and | 14 | | (5) the appropriate referral techniques, including the | 15 | | name and contact number of the school or school district | 16 | | homeless liaison. | 17 | | School boards may work with a community-based organization | 18 | | that specializes in working with homeless children and youth | 19 | | to develop and provide the training. | 20 | | (b-35) The training regarding educator ethics and | 21 | | responding to child sexual abuse and grooming behavior shall | 22 | | include, but is not limited to, teacher-student conduct, | 23 | | school employee-student conduct, and evidence-informed | 24 | | training on preventing, recognizing, reporting, and responding | 25 | | to child sexual abuse and grooming as outlined in Section | 26 | | 10-23.13. |

| 1 | | (b-40) The training regarding effective instruction in | 2 | | violence prevention and conflict resolution required by this | 3 | | Section shall be conducted in accordance with the requirements | 4 | | of Section 27-23.4. | 5 | | (b-45) (c) Beginning July 1, 2024, all nonpublic | 6 | | elementary and secondary school teachers, administrators, and | 7 | | school support personnel shall complete the training set forth | 8 | | in subsection (b-5).
