AMENDMENT TO SENATE BILL 1437

AMENDMENT NO. ______. Amend Senate Bill 1437 by replacing everything after the enacting clause with the following:

"Section 5. The Illinois Century Network Act is amended by changing Section 7 and by adding Section 30 as follows:

Sec. 7. Definitions. As Beginning on July 1, 2018, as used in this Act: ,

"Anchor anchor institutions" or "community anchor institutions" means Illinois schools, institutions of higher education, libraries, museums, research institutions, State agencies, and units of local government.

"End-to-end network" means the entirety of the broadband network, including both the middle-mile and last-mile network.

"Symmetrical service" means service with equal download and upload speeds.

Sec. 30. Dates of completion.

(a) Subject to appropriation, the Department of Innovation and Technology shall connect all prioritized community anchor institutions to the Illinois Century Network and provide at least 10 gigabit per second (Gbps) symmetrical service for 80% of schools, 80% of correctional facilities, and 13% of libraries and at least 1 Gbps symmetrical service for all other prioritized connected community anchor institutions by January 1, 2030. The Department of Innovation and Technology may accomplish this requirement by either using commercial providers engaged through a competitive bidding process or by operating its own network. The Department of Innovation and Technology shall determine, by rule, which community anchor institutions are prioritized.

(b) Subject to appropriation, the Department of Innovation and Technology shall own and operate the end-to-end network and connect all community anchor institutions to the network, providing at least 10 Gbps symmetrical service for 80% of schools, 80% of correctional facilities, and 13% of libraries and at least 1 Gbps symmetrical service for all other community anchor institutions, by January 1, 2050.

Section 99. Effective date. This Act takes effect upon becoming law.".
