AMENDMENT TO HOUSE BILL 4427

2    AMENDMENT NO. ______. Amend House Bill 4427 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Assisted Living and Shared Housing Act is
5amended by changing Section 113 as follows:
 
6    (210 ILCS 9/113)
7    Sec. 113. Assisted Living and Shared Housing Advisory
8Board.
9    (a) The Governor shall establish an Assisted Living and
10Shared Housing Advisory Board. The Advisory Board shall
11consist of the following members:
12        (1) the Director, who shall serve as chair and as an ex
13    officio, nonvoting member;
14        (2) the Director of Aging, who shall serve as
15    vice-chair and as an ex officio, nonvoting member;
16        (3) the following nonvoting members, appointed by the

1    Director:
2            (A) one representative of the Department; and
3            (B) one representative of the Department on Aging,
4        appointed in consultation with the Director of Aging;
5        (4) the following voting members, appointed by the
6    Director:
7            (A) 6 members selected from candidates recommended
8        by an organization of providers whose membership
9        consists of assisted living establishments;
10            (B) 3 members, one of whom must be a resident of an
11        assisted living or shared housing establishment,
12        selected appointed by the Director from candidates
13        recommended by a consumer organizations organization
14        that engage engages solely in advocacy or legal
15        representation on behalf of senior citizens;
16            (C) a physician;
17            (D) a registered professional nurse; and
18            (E) 2 members with expertise in the area of
19        gerontology research or legal research regarding
20        implementation of laws applying to assisted living
21        establishments.
22    (b) Members of the Advisory Board shall serve for terms of
233 years or until the member's successor is appointed by the
24Director, but the Director shall stagger the terms of initial
25appointees to the Advisory Board as follows: the terms of
26one-third shall expire after one year; the terms of one-third

1shall expire after 2 years; and the terms of one-third shall
2expire after 3 years. All initial members shall be appointed
3by January 1, 2025. Any member appointed to fill a vacancy
4occurring before the expiration of the term for which his or
5her predecessor was appointed shall be appointed for the
6remainder of that term. The Advisory Board shall meet
7quarterly and at the call of the Director. The affirmative
8vote of 9 voting members of the Advisory Board shall be
9necessary for any action of the Advisory Board. Members of the
10Advisory Board shall receive no compensation for their
11services but shall be reimbursed for their actual expenses.
12    (c) The Advisory Board shall be provided copies of any
13additions or changes to the Assisted Living and Shared Housing
14Establishment Code for review and comment prior to notice
15being given to the public. If the Advisory Board, having been
16asked for its review, fails to advise the Department within 90
17days, the additions or changes shall be considered acted upon
18in accordance with this Section.
