SYNOPSIS AS INTRODUCED:
 
210 ILCS 9/113

    Amends the Assisted Living and Shared Housing Act. Provides that one representative of the Office of the State Long Term Care Ombudsman (instead of one representative of the Department on Aging) is a nonvoting member of the Assisted Living and Shared Housing Advisory Board. Adds a certified long term care ombudsman and 3 current or former residents of an assisted living establishment or shared housing establishment as voting members of the Board.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Assisted Living and Shared Housing Act is
5amended by changing Section 113 as follows:
 
6    (210 ILCS 9/113)
7    Sec. 113. Assisted Living and Shared Housing Advisory
8Board.
9    (a) The Governor shall establish an Assisted Living and
10Shared Housing Advisory Board. The Advisory Board shall
11consist of the following members:
12        (1) the Director, who shall serve as chair and as an ex
13    officio, nonvoting member;
14        (2) the Director of Aging, who shall serve as
15    vice-chair and as an ex officio, nonvoting member;
16        (3) the following nonvoting members, appointed by the
17    Director:
18            (A) one representative of the Department; and
19            (B) one representative of the Office of the State
20        Long Term Care Ombudsman Department on Aging;
21        (4) the following voting members, appointed by the
22    Director:
23            (A) 6 members selected from candidates recommended

1        by an organization of providers whose membership
2        consists of assisted living establishments;
3            (B) 3 members appointed by the Director from
4        candidates recommended by a consumer organization that
5        engages solely in advocacy or legal representation on
6        behalf of senior citizens;
7            (C) a physician;
8            (D) a registered professional nurse; and
9            (E) 2 members with expertise in the area of
10        gerontology research or legal research regarding
11        implementation of laws applying to assisted living
12        establishments; .
13            (F) a certified long term care ombudsman; and
14            (G) 3 current or former residents of an assisted
15        living establishment or shared housing establishment.
16    (b) Members of the Advisory Board shall serve for terms of
173 years or until the member's successor is appointed by the
18Director, but the Director shall stagger the terms of initial
19appointees to the Advisory Board as follows: the terms of
20one-third shall expire after one year; the terms of one-third
21shall expire after 2 years; and the terms of one-third shall
22expire after 3 years. All initial members shall be appointed
23by January 1, 2025. Any member appointed to fill a vacancy
24occurring before the expiration of the term for which his or
25her predecessor was appointed shall be appointed for the
26remainder of that term. The Advisory Board shall meet

1quarterly and at the call of the Director. The affirmative
2vote of 9 voting members of the Advisory Board shall be
3necessary for any action of the Advisory Board. Members of the
4Advisory Board shall receive no compensation for their
5services but shall be reimbursed for their actual expenses.
6    (c) The Advisory Board shall be provided copies of any
7additions or changes to the Assisted Living and Shared Housing
8Establishment Code for review and comment prior to notice
9being given to the public. If the Advisory Board, having been
10asked for its review, fails to advise the Department within 90
11days, the additions or changes shall be considered acted upon
12in accordance with this Section.
