AMENDMENT TO HOUSE BILL 4253

2    AMENDMENT NO. ______. Amend House Bill 4253 by replacing
3line 17 on page 4 through line 16 on page 5 with the following:
 
4    "Section 90. The Criminal Code of 2012 is amended by
5changing Section 12C-50 as follows:
 
6    (720 ILCS 5/12C-50)
7    Sec. 12C-50. Hazing.
8    (a) A person commits hazing when he or she knowingly
9requires the performance of any act by a student or other
10person in a school, college, university, or other educational
11institution of this State, for the purpose of conferring,
12gaining, or maintaining acceptance, membership, office, or
13other status in induction or admission into any group,
14organization, or society associated or connected with that
15institution, regardless of the student or other person's
16willingness to perform the act, if:

1        (1) the act is neither not sanctioned or authorized by
2    that educational institution nor is a customary athletic
3    event; and
4        (2) the act either (i) subjects any person to a
5    substantial risk of physical harm, mental harm, or
6    degradation or (ii) causes any person to suffer physical
7    harm, mental harm, or degradation results in bodily harm
8    to any person.
9    (b) Sentence. Hazing is a Class A misdemeanor, except that
10hazing that results in death or great bodily harm is a Class 4
11felony.
