AMENDMENT TO HOUSE BILL 3972

AMENDMENT NO. ______. Amend House Bill 3972 on page 1, by replacing lines 6 through 8 with the following:

"(30 ILCS 500/25-210 new)

Sec. 25-210. Generic prescription drug contracting.

(a) As used in this Section:

"Eligible prescription drug" means a prescription drug approved under subsection (c) of Section 505 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 355(c)) that is not under patent.

"Generic drug" means a drug approved in accordance with an application that references an eligible prescription drug and that is submitted under subsection (j) of Section 505 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 355(j)).
