AMENDMENT TO HOUSE BILL 3516

2    AMENDMENT NO. ______. Amend House Bill 3516 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Employee Blood Donation Leave Act is
5amended by changing Sections 1, 3, 5, and 10 as follows:
 
6    (820 ILCS 149/1)
7    Sec. 1. Short title. This Act may be cited as the Employee
8Blood and Organ Donation Leave Act.

11    Sec. 3. Purpose. This Act is intended to provide time off
12with pay to allow employees of units of local government,
13boards of election commissioners, or private employers in the
14State of Illinois to donate blood or an organ.

1    (820 ILCS 149/5)
2    Sec. 5. Definitions. As used in this Act:
3    "Employer" means any unit of local government, board of
4election commissioners, or any private employer in the State
5who has 51 or more employees.
6    "Department" means the Department of Public Health.
7    "Organ" means any biological tissue of the human body that
8may be donated by a living donor, including, but not limited
9to, the kidney, liver, lung, pancreas, intestine, bone, and
10skin or any subpart thereof.
11    "Participating employee" means a full-time employee who
12has been employed by an employer for a period of 6 months or
13more and who donates blood or an organ.

16    Sec. 10. Paid leave for blood donation; administration.
17    (a) On request, a participating employee subject to this
18Act may be entitled to blood donation leave with pay to donate
19blood or an organ.
20    (b) An employee may use up to one hour, or more if
21authorized by the employer or a collective bargaining
22agreement, to donate blood every 56 days in accordance with
23appropriate medical standards established by the American Red
24Cross, America's Blood Centers, the American Association of

1Blood Banks, or other nationally recognized standards.
2    (b-5) An employee may use up to 10 days of leave in any
312-month period to serve as an organ donor.
4    (c) A participating employee may use the leave authorized
5in subsection (b) or (b-5) of this Section only after
6obtaining approval from the employer.
7    (d) The Department must adopt rules governing blood
8donation leave taken to donate blood or an organ, including
9rules that (i) establish conditions and procedures for
10requesting and approving leave and (ii) require medical
11documentation of the proposed blood or organ donation before
12leave is approved by the employer.
