AMENDMENT TO HOUSE BILL 3516

2    AMENDMENT NO. ______. Amend House Bill 3516, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Employee Blood Donation Leave Act is
6amended by changing Sections 1, 3, 5, and 10 as follows:

8    Sec. 1. Short title. This Act may be cited as the Employee
9Blood and Organ Donation Leave Act.

12    Sec. 3. Purpose. This Act is intended to provide time off
13with pay to allow employees of units of local government,
14boards of election commissioners, or private employers in the
15State of Illinois to donate blood, an organ, or bone marrow.

3    Sec. 5. Definitions. As used in this Act:
4    "Employer" means any unit of local government, board of
5election commissioners, or any private employer in the State
6who has 51 or more employees.
7    "Department" means the Department of Public Health.
8    "Organ" means any biological tissue of the human body that
9may be donated by a living donor, including, but not limited
10to, the kidney, liver, lung, pancreas, intestine, bone, and
11skin or any subpart thereof.
12    "Participating employee" means a full-time employee who
13has been employed by an employer for a period of 6 months or
14more and who donates blood, an organ, or bone marrow.

17    Sec. 10. Paid leave for blood donation; administration.
18    (a) On request, a participating employee subject to this
19Act may be entitled to blood donation leave with pay to donate
20blood, an organ, or bone marrow.
21    (b) An employee may use up to one hour, or more if
22authorized by the employer or a collective bargaining
23agreement, to donate blood every 56 days in accordance with
24appropriate medical standards established by the American Red

1Cross, America's Blood Centers, the American Association of
2Blood Banks, or other nationally recognized standards.
3    (b-5) An employee may use up to 10 days of leave in any
412-month period to serve as an organ donor.
5    (b-10) An employee may use up to 5 days of leave in any
612-month period to serve as a bone marrow donor.
7    (c) A participating employee may use the leave authorized
8in subsection (b), (b-5), or (b-10) of this Section only after
9obtaining approval from the employer.
10    (d) The Department must adopt rules governing blood
11donation leave taken to donate blood, an organ, or bone
12marrow, including rules that (i) establish conditions and
13procedures for requesting and approving leave and (ii) require
14medical documentation of the proposed blood, organ, or bone
15marrow donation before leave is approved by the employer.
