| 1 | | AN ACT concerning State government.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Civil Administrative Code of Illinois is | 5 | | amended by changing Section 5-715 as follows: | 6 | | (20 ILCS 5/5-715) | 7 | | Sec. 5-715. Expedited licensure for service members and | 8 | | spouses. | 9 | | (a) In this Section, "service member" means any person | 10 | | who, at the time of application under this Section, is an | 11 | | active duty member of the United States Armed Forces or any | 12 | | reserve component of the United States Armed Forces, the Coast | 13 | | Guard, or the National Guard of any state, commonwealth, or | 14 | | territory of the United States or the District of Columbia or | 15 | | whose active duty service concluded within the preceding 2 | 16 | | years before application. | 17 | | (a-5) The Department of Financial and Professional | 18 | | Regulation shall within 180 days after January 1, 2020 (the | 19 | | effective date of Public Act 101-240) designate one staff | 20 | | member as the military liaison within the Department of | 21 | | Financial and Professional Regulation to ensure proper | 22 | | enactment of the requirements of this Section. The military | 23 | | liaison's responsibilities shall also include, but are not |

| 1 | | limited to: (1) the management of all expedited applications | 2 | | to ensure processing within 30 days after receipt of a | 3 | | completed application , including notification of federal | 4 | | assistance programs available to reimburse costs associated | 5 | | with applicable licensing fees and professional credentials | 6 | | for service members and their families pursuant to Section 556 | 7 | | of Public Law 115-91, or any related federal program ; (2) | 8 | | coordination with all military installation military and | 9 | | family support center directors within this State, including | 10 | | virtual, phone, or in-person periodic meetings with each | 11 | | military installation military and family support center; and | 12 | | (3) training by the military liaison to all directors of each | 13 | | division that issues an occupational or professional license | 14 | | to ensure proper application of this Section. At the end of | 15 | | each calendar year, the military liaison shall provide an | 16 | | annual report documenting the expedited licensure program for | 17 | | service members and spouses, and shall deliver that report to | 18 | | the Secretary of Financial and Professional Regulation and the | 19 | | Lieutenant Governor. | 20 | | (b) Each director of a department that issues an | 21 | | occupational or professional license is authorized to and | 22 | | shall issue an expedited license to a service member who meets | 23 | | the requirements under this Section. Review and determination | 24 | | of an application for a license issued by the department shall | 25 | | be expedited by the department within 30 days after the date on | 26 | | which the department receives all necessary documentation |

| 1 | | required for licensure, including any required information | 2 | | from State and federal agencies. An expedited license shall be | 3 | | issued by the department to any service members meeting the | 4 | | application requirements of this Section, regardless of | 5 | | whether the service member currently resides in this State. | 6 | | The service member shall apply to the department on forms | 7 | | provided by the department. An application must include proof | 8 | | that: | 9 | | (1) the applicant is a service member; | 10 | | (2) the applicant holds a valid license in good | 11 | | standing for the occupation or profession issued by | 12 | | another state, commonwealth, possession, or territory of | 13 | | the United States, the District of Columbia, or any | 14 | | foreign jurisdiction; | 15 | | (2.5) the applicant meets the requirements and | 16 | | standards for licensure through endorsement or reciprocity | 17 | | for the occupation or profession for which the applicant | 18 | | is applying; | 19 | | (3) the applicant is assigned to a duty station in | 20 | | this State, has established legal residence in this State, | 21 | | or will reside in this State within 6 months after the date | 22 | | of application for licensure; | 23 | | (4) a complete set of the applicant's fingerprints has | 24 | | been submitted to the Illinois State Police for statewide | 25 | | and national criminal history checks, if applicable to the | 26 | | requirements of the department issuing the license; the |

| 1 | | applicant shall pay the fee to the Illinois State Police | 2 | | or to the fingerprint vendor for electronic fingerprint | 3 | | processing; no temporary occupational or professional | 4 | | license shall be issued to an applicant if the statewide | 5 | | or national criminal history check discloses information | 6 | | that would cause the denial of an application for | 7 | | licensure under any applicable occupational or | 8 | | professional licensing Act; | 9 | | (5) the applicant is not ineligible for licensure | 10 | | pursuant to Section 2105-165 of the Civil Administrative | 11 | | Code of Illinois; | 12 | | (6) the applicant has submitted an application for | 13 | | full licensure; and | 14 | | (7) the applicant has paid the required fee; fees | 15 | | shall not be refundable. | 16 | | (c) Each director of a department that issues an | 17 | | occupational or professional license is authorized to and | 18 | | shall issue an expedited license to the spouse of a service | 19 | | member who meets the requirements under this Section. | 1 | | or national criminal history check discloses information | 2 | | that would cause the denial of an application for | 3 | | licensure under any applicable occupational or | 4 | | professional licensing Act; | 5 | | (5) the applicant is not ineligible for licensure | 6 | | pursuant to Section 2105-165 of the Civil Administrative | 7 | | Code of Illinois; | 8 | | (6) the applicant has submitted an application for | 9 | | full licensure; and | 10 | | (7) the applicant has paid the required fee; fees | 11 | | shall not be refundable. | 12 | | (c-5) If a service member or his or her spouse relocates | 13 | | from this State, he or she shall be provided an opportunity to | 14 | | place his or her license in inactive status through | 15 | | coordination with the military liaison. If the service member | 16 | | or his or her spouse returns to this State, he or she may | 17 | | reactivate the license in accordance with the statutory | 18 | | provisions regulating the profession and any applicable | 19 | | administrative rules. The license reactivation shall be | 20 | | expedited and completed within 30 days after receipt of a | 21 | | completed application to reactivate the license. A license | 22 | | reactivation is only applicable when the valid license for | 23 | | which the first issuance of a license was predicated is still | 24 | | valid and in good standing. An application to reactivate a | 25 | | license must include proof that

| 1 | | profession issued in another State, commonwealth, possession, | 2 | | or territory of the United States, the District of Columbia, | 3 | | or any foreign jurisdiction. | 4 | | (d) All relevant experience of a service member or his or | 5 | | her spouse in the discharge of official duties, including | 6 | | full-time and part-time experience, shall be credited in the | 7 | | calculation of any years of practice in an occupation or | 8 | | profession as may be required under any applicable | 9 | | occupational or professional licensing Act. All relevant | 10 | | training provided by the military and completed by a service | 11 | | member shall be credited to that service member as meeting any | 12 | | training or education requirement under any applicable | 13 | | occupational or professional licensing Act, provided that the | 14 | | training or education is determined by the department to meet | 15 | | the requirements under any applicable Act and is not otherwise | 16 | | contrary to any other licensure requirement. | 17 | | (e) A department may adopt any rules necessary for the | 18 | | implementation and administration of this Section and shall by | 19 | | rule provide for fees for the administration of this Section.
