AMENDMENT TO HOUSE BILL 2828

AMENDMENT NO. ______. Amend House Bill 2828 by replacing everything after the enacting clause with the following:

"Section 5. The Vector Control Act is amended by changing Section 2 and by adding Sections 1.5 and 3.5 as follows:

(410 ILCS 95/1.5 new)

Sec. 1.5. Legislative intent. The General Assembly recognizes that:

(1) climate change is a factor in future mosquito-borne and vector-borne diseases;

(2) there is a need to ensure environmental protection as well as the protection of public health and the quality of life; and

(3) an integrated pest management approach is the best way to balancing these goals.

Sec. 2. For the purposes of this Act:

"Arthropod" means a mosquito or other invertebrate animal with jointed legs and a segmented body.

"Commercial pesticide applicator" means a person certified or licensed under the Structural Pest Control Act or the Illinois Pesticide Act who contracts to apply a pesticide within the scope of his or her certification or license.

"Department" means the Illinois Department of Public Health.

"Director" means the Director of the Illinois Department of Public Health.

"Integrated pest management" means modification of the life system of a vector or pest to reduce its numbers to an acceptable level by applying current biological and technological knowledge to achieve the desired modification in a manner that ensures protection of the environment and public health.

"Integrated vector management approach" means an approach that prioritizes prevention, biological, and nonchemical means of controlling disease vectors and prioritizes a data-driven approach to vector management.

"Local health authority" means the full-time health department, as recognized by the Department, having jurisdiction over a particular area.

"Pest" means undesirable arthropods (including certain insects, spiders, mites, ticks and related organisms), wood infesting organisms, rats, mice, birds and any other obnoxious or undesirable animals.

"Vector" means arthropods, rats, mice, birds or other animals capable of carrying disease-producing organisms to a human or animal host. "Vector" does not include animals that transmit disease to humans only when used as human food.

Sec. 3.5. Integrated vector management plan; public notification prior to use of wide-area chemical pesticides from the public right of way.

(a) An organization performing mosquito control as a public service shall submit to the Department a written integrated vector management plan.

(b) This Section does not apply to the Department mosquito control grantees who are supervised by the Department on the effective date of this amendatory Act of the 103rd General Assembly.

(c) This Section does not apply to any business or person regulated under the Structural Pest Control Act.

(d) A vector management organization shall establish and maintain a system of public notification prior to the use of wide-area chemical pesticides from the public right of way.

(e) A vector management plan shall consist of a plan for the prevention, biological, and nonchemical means of controlling disease vectors based upon scientific data prescribed by the Department.

Section 99. Effective date. This Act takes effect January 1, 2024.".
