AMENDMENT TO HOUSE BILL 2828

2    AMENDMENT NO. ______. Amend House Bill 2828 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Vector Control Act is amended by changing
5Section 2 and by adding Sections 1.5 and 3.5 as follows:
 
6    (410 ILCS 95/1.5 new)
7    Sec. 1.5. Legislative intent. The General Assembly
8recognizes that:
9    (1) climate change is a factor in future mosquito-borne
10and vector-borne diseases;
11    (2) there is a need to ensure environmental protection as
12well as the protection of public health and the quality of
13life; and
14    (3) an integrated pest management approach is the best way
15to balancing these goals.

1    (410 ILCS 95/2)  (from Ch. 111 1/2, par. 7802)
2    Sec. 2. For the purposes of this Act:
3    "Arthropod" means a mosquito or other invertebrate animal
4with jointed legs and a segmented body.
5    "Commercial pesticide applicator" means a person certified
6or licensed under the Structural Pest Control Act or the
7Illinois Pesticide Act who contracts to apply a pesticide
8within the scope of his or her certification or license.
9    "Department" means the Illinois Department of Public
10Health.
11    "Director" means the Director of the Illinois Department
12of Public Health.
13    "Integrated pest management" means modification of the
14life system of a vector or pest to reduce its numbers to an
15acceptable level by applying current biological and
16technological knowledge to achieve the desired modification in
17a manner that ensures protection of the environment and public
18health.
19    "Integrated vector management approach" means an approach
20that prioritizes prevention, biological, and nonchemical means
21of controlling disease vectors and prioritizes a data-driven
22approach to vector management.
23    "Local health authority" means the full-time health
24department, as recognized by the Department, having
25jurisdiction over a particular area.
26    "Pest" means undesirable arthropods (including certain

1insects, spiders, mites, ticks and related organisms), wood
2infesting organisms, rats, mice, birds and any other obnoxious
3or undesirable animals.
4    "Vector" means arthropods, rats, mice, birds or other
5animals capable of carrying disease-producing organisms to a
6human or animal host. "Vector" does not include animals that
7transmit disease to humans only when used as human food.

10    Sec. 3.5. Integrated vector management plan; public
11notification prior to use of wide-area chemical pesticides
12from the public right of way.
13    (a) An organization performing mosquito control as a
14public service shall submit to the Department a written
15integrated vector management plan.
16    (b) This Section does not apply to the Department mosquito
17control grantees who are supervised by the Department on the
18effective date of this amendatory Act of the 103rd General
19Assembly.
20    (c) This Section does not apply to any business or person
21regulated under the Structural Pest Control Act.
22    (d) A vector management organization shall establish and
23maintain a system of public notification prior to the use of
24wide-area chemical pesticides from the public right of way.
25    (e) A vector management plan shall consist of a plan for

1the prevention, biological, and nonchemical means of
2controlling disease vectors based upon scientific data
3prescribed by the Department.
 
4    Section 99. Effective date. This Act takes effect January
51, 2024.".
