SYNOPSIS AS INTRODUCED:
 
415 ILCS 60/13.10 new

    Amends the Illinois Pesticide Act. Provides that, if a unit of local government, including, but not limited to, a mosquito abatement district, intends to engage in mosquito abatement activities requiring the application of a pesticide, then the unit of local government shall provide notice of its intent to apply the pesticide to those individuals who reside within the geographic area where the pesticide is to be applied. Specifies that the notice must be supplied to the affected individuals not less than 4 days before the pesticide is to be applied for mosquito abatement purposes. Authorizes the notice to be provided by radio or television advertisements, mailings to potentially affected individuals, or electronic notices posted on the website of the unit of local government. Provides that, if a unit of local government is notified by an individual that the individual does not wish to have pesticides applied near the individual's place of residence, then the unit of local government shall not apply pesticides within 200 feet of that residence. Effective January 1, 2024.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Pesticide Act is amended by adding
5Section 13.10 as follows:
 
6    (415 ILCS 60/13.10 new)
7    Sec. 13.10. Notification of mosquito control efforts. If a
8unit of local government, including, but not limited to a
9mosquito abatement district, intends to engage in mosquito
10abatement activities requiring the application of a pesticide,
11the unit of local government shall provide notice of its
12intent to apply the pesticide to those individuals who reside
13within the geographic area where the pesticide is to be
14applied. The notice required under this Section must be
15supplied to the affected individuals not less than 4 days
16before the pesticide is to be applied for mosquito abatement
17purposes and may be provided by radio or television
18advertisements, mailings to potentially affected individuals,
19or electronic notices posted on the website of the unit of
20local government. If a unit of local government is notified by
21an individual that the individual does not wish to have
22pesticides applied near the individual's place of residence,
23then the unit of local government shall not apply pesticides

2    Section 99. Effective date. This Act takes effect January
31, 2024.
