AMENDMENT TO HOUSE BILL 2822

2    AMENDMENT NO. ______. Amend House Bill 2822 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by adding Section
52-3.204 as follows:
 
6    (105 ILCS 5/2-3.204 new)
7    Sec. 2-3.204. Supporting Newcomer Students Program.
8    (a) As used in this Section, "newcomer student" means a
9student who is 3 years of age or older but below the age of 22
10years, who was born outside of the 50 states of the United
11States, the District of Columbia, or the Commonwealth of
12Puerto Rico, and who has been newly attending one or more
13schools in any one or more states, the District of Columbia, or
14the Commonwealth of Puerto Rico for less than 3 full school
15years, regardless of immigration status.
16    (b) Subject to a specific State appropriation, the State

1Board of Education shall implement and administer a Supporting
2Newcomer Students Program to make funding available to a
3school district to support the needs of newcomer students in
4the school district.
5    (c) Subject to appropriation for the Program, the State
6Board of Education shall annually disseminate a request for
7applications to the Program, and funds shall be awarded
8annually under the Program. In awarding funds under the
9Program, the State Board of Education may consider (i) the
10number of newcomer students enrolled in preschool, elementary
11school, and secondary school within a school district, (ii)
12the needs of newcomer students in a school district, and (iii)
13the ability of a school district to meet the needs of newcomer
14students.
15    (d) A school district organized under Article 34 of this
16Code is eligible to receive no more than 30% of the funds
17appropriated for the Program annually.
 
18    Section 99. Effective date. This Act takes effect July 1,
192024.".
