SYNOPSIS AS INTRODUCED:
 
740 ILCS 82/5

    Amends the Gender Violence Act. Provides that "gender-related violence" means, among other meanings, contact between a sexual organ from which a condom has been removed and the intimate part of another who did not verbally consent to the condom being removed and contact between an intimate part of the person and a sexual organ of another from which the person removed a condom without verbal consent.

1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Gender Violence Act is amended by changing
5Section 5 as follows:
 
6    (740 ILCS 82/5)
7    Sec. 5. Definition. In this Act, "gender-related
8violence", which is a form of sex discrimination, means the
9following:
10        (1) One or more acts of violence or physical
11    aggression satisfying the elements of battery under the
12    laws of Illinois that are committed, at least in part, on
13    the basis of a person's sex, whether or not those acts have
14    resulted in criminal charges, prosecution, or conviction.
15        (2) A physical intrusion or physical invasion of a
16    sexual nature under coercive conditions satisfying the
17    elements of battery under the laws of Illinois, whether or
18    not the act or acts resulted in criminal charges,
19    prosecution, or conviction.
20        (2.1) Contact between a sexual organ from which a
21    condom has been removed and the intimate part of another
22    who did not verbally consent to the condom being removed.
23        (2.2) Contact between an intimate part of the person

1    and a sexual organ of another from which the person
2    removed a condom without verbal consent.
3        (3) A threat of an act described in item (1), or (2),
4    (2.1), or (2.2) causing a realistic apprehension that the
5    originator of the threat will commit the act.
