AMENDMENT TO HOUSE BILL 814

2    AMENDMENT NO. ______. Amend House Bill 814 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Children and Family Services Act is
5amended by changing Section 5.15 as follows:
 
6    (20 ILCS 505/5.15)
7    Sec. 5.15. Daycare; Department of Human Services.
8    (a) For the purpose of ensuring effective statewide
9planning, development, and utilization of resources for the
10day care of children, operated under various auspices, the
11Department of Human Services, or any other State agency that
12assumes these responsibilities, is designated to coordinate
13all day care activities for children of the State and shall
14develop or continue, and shall update every year, a State
15comprehensive day-care plan for submission to the Governor
16that identifies high-priority areas and groups, relating them

1to available resources and identifying the most effective
2approaches to the use of existing day care services. The State
3comprehensive day-care plan shall be made available to the
4General Assembly following the Governor's approval of the
5plan.
6    The plan shall include methods and procedures for the
7development of additional day care resources for children to
8meet the goal of reducing short-run and long-run dependency
9and to provide necessary enrichment and stimulation to the
10education of young children. Recommendations shall be made for
11State policy on optimum use of private and public, local,
12State and federal resources, including an estimate of the
13resources needed for the licensing and regulation of day care
14facilities.
15    A written report shall be submitted to the Governor and
16the General Assembly annually on April 15. The report shall
17include an evaluation of developments over the preceding
18fiscal year, including cost-benefit analyses of various
19arrangements. Beginning with the report in 1990 submitted by
20the Department's predecessor agency and every 2 years
21thereafter, the report shall also include the following:
22        (1) An assessment of the child care services, needs
23    and available resources throughout the State and an
24    assessment of the adequacy of existing child care
25    services, including, but not limited to, services assisted
26    under this Act and under any other program administered by

1    other State agencies.
2        (2) A survey of day care facilities to determine the
3    number of qualified caregivers, as defined by rule,
4    attracted to vacant positions, or retained at the current
5    position, and any problems encountered by facilities in
6    attracting and retaining capable caregivers. The report
7    shall include an assessment, based on the survey, of
8    improvements in employee benefits that may attract capable
9    caregivers. The survey must include a list of specific
10    benefits, including, but not limited to, health care,
11    retirement plans, and child care subsidies.
12        (3) The average wages and salaries and fringe benefit
13    packages paid to caregivers throughout the State, computed
14    on a regional basis, compared to similarly qualified
15    employees in other but related fields.
16        (4) The qualifications of new caregivers hired at
17    licensed day care facilities during the previous 2-year
18    period.
19        (5) Recommendations for increasing caregiver wages and
20    salaries to ensure quality care for children.
21        (6) Evaluation of the fee structure and income
22    eligibility for child care subsidized by the State.
23        (7) A survey of early childhood staff who leave the
24    workforce to determine strategies for the Child Care
25    Development Fund and General Revenue funds that can be
26    used to promote workforce retention, such as extending

1    child care assistance to the entire workforce regardless
2    of income eligibility. The survey shall also determine the
3    costs of utilizing such strategies with the best
4    verifiable data available. Initial findings from the
5    survey shall be available to the public by April 15, 2025
6    and updated annually thereafter using data from the
7    preceding fiscal year.
8    The requirement for reporting to the General Assembly
9shall be satisfied by filing copies of the report as required
10by Section 3.1 of the General Assembly Organization Act, and
11filing such additional copies with the State Government Report
12Distribution Center for the General Assembly as is required
13under paragraph (t) of Section 7 of the State Library Act.
14    (b) The Department of Human Services shall establish
15policies and procedures for developing and implementing
16interagency agreements with other agencies of the State
17providing child care services or reimbursement for such
18services. The plans shall be annually reviewed and modified
19for the purpose of addressing issues of applicability and
20service system barriers.
21    (c) In cooperation with other State agencies, the
22Department of Human Services shall develop and implement, or
23shall continue, a resource and referral system for the State
24of Illinois either within the Department or by contract with
25local or regional agencies. Funding for implementation of this
26system may be provided through Department appropriations or

1other inter-agency funding arrangements. The resource and
2referral system shall provide at least the following services:
3        (1) Assembling and maintaining a data base on the
4    supply of child care services.
5        (2) Providing information and referrals for parents.
6        (3) Coordinating the development of new child care
7    resources.
8        (4) Providing technical assistance and training to
9    child care service providers.
10        (5) Recording and analyzing the demand for child care
11    services.
12    (d) The Department of Human Services shall conduct day
13care planning activities with the following priorities:
14        (1) Development of voluntary day care resources
15    wherever possible, with the provision for grants-in-aid
16    only where demonstrated to be useful and necessary as
17    incentives or supports. By January 1, 2002, the Department
18    shall design a plan to create more child care slots as well
19    as goals and timetables to improve quality and
20    accessibility of child care.
21        (2) Emphasis on service to children of recipients of
22    public assistance when such service will allow training or
23    employment of the parent toward achieving the goal of
24    independence.
25        (3) (Blank).
26        (4) Care of children from families in stress and

1    crises whose members potentially may become, or are in
2    danger of becoming, non-productive and dependent.
3        (5) Expansion of family day care facilities wherever
4    possible.
5        (6) Location of centers in economically depressed
6    neighborhoods, preferably in multi-service centers with
7    cooperation of other agencies. The Department shall
8    coordinate the provision of grants, but only to the extent
9    funds are specifically appropriated for this purpose, to
10    encourage the creation and expansion of child care centers
11    in high need communities to be issued by the State,
12    business, and local governments.
13        (7) Use of existing facilities free of charge or for
14    reasonable rental whenever possible in lieu of
15    construction.
16        (8) Development of strategies for assuring a more
17    complete range of day care options, including provision of
18    day care services in homes, in schools, or in centers,
19    which will enable a parent or parents to complete a course
20    of education or obtain or maintain employment and the
21    creation of more child care options for swing shift,
22    evening, and weekend workers and for working women with
23    sick children. The Department shall encourage companies to
24    provide child care in their own offices or in the building
25    in which the corporation is located so that employees of
26    all the building's tenants can benefit from the facility.

1        (9) Development of strategies for subsidizing students
2    pursuing degrees in the child care field.
3        (10) Continuation and expansion of service programs
4    that assist teen parents to continue and complete their
5    education.
6    Emphasis shall be given to support services that will help
7to ensure such parents' graduation from high school and to
8services for participants in any programs of job training
9conducted by the Department.
10    (e) The Department of Human Services shall actively
11stimulate the development of public and private resources at
12the local level. It shall also seek the fullest utilization of
13federal funds directly or indirectly available to the
14Department.
15    Where appropriate, existing non-governmental agencies or
16associations shall be involved in planning by the Department.
17    (f) To better accommodate the child care needs of low
18income working families, especially those who receive
19Temporary Assistance for Needy Families (TANF) or who are
20transitioning from TANF to work, or who are at risk of
21depending on TANF in the absence of child care, the Department
22shall complete a study using outcome-based assessment
23measurements to analyze the various types of child care needs,
24including but not limited to: child care homes; child care
25facilities; before and after school care; and evening and
26weekend care. Based upon the findings of the study, the

1Department shall develop a plan by April 15, 1998, that
2identifies the various types of child care needs within
3various geographic locations. The plan shall include, but not
4be limited to, the special needs of parents and guardians in
5need of non-traditional child care services such as early
6mornings, evenings, and weekends; the needs of very low income
7families and children and how they might be better served; and
8strategies to assist child care providers to meet the needs
9and schedules of low income families.
