1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Clinical Social Work and Social Work
5Practice Act is amended by changing Sections 5, 8, 9A, and 11
6as follows:

9    Sec. 5. Powers and duties of the Department. Subject to
10the provisions of this Act, the Department shall exercise the
11following functions, powers, and duties:
12        (1) Conduct or authorize examinations to ascertain the
13    qualifications and fitness of candidates for a license to
14    engage in the independent practice of clinical social work
15    and in the practice of social work, pass upon the
16    qualifications of applicants for licenses, and issue
17    licenses to those who are found to be fit and qualified.
18        (2) Adopt rules required for the administration and
19    enforcement of this Act.
20        (3) Adopt rules for determining approved undergraduate
21    and graduate social work degree programs and prepare and
22    maintain a list of colleges and universities offering such
23    approved programs whose graduates, if they otherwise meet

1    the requirements of this Act, are eligible to apply for a
2    license.
3        (4) Prescribe forms to be issued for the
4    administration and enforcement of this Act consistent with
5    and reflecting the requirements of this Act and rules
6    adopted pursuant to this Act.
7        (5) Conduct investigations related to possible
8    violations of this Act.
9        (6) Maintain rosters of the names and addresses of all
10    persons who hold valid licenses under this Act. These
11    rosters shall be available upon written request and
12    payment of the required fee.

16    Sec. 8. Examination.
17    (1) The Department shall authorize examinations of
18applicants at such times and places as it may determine. Each
19examination shall be of a character to fairly test the
20competence and qualifications of the applicants to practice as
21a licensed clinical social worker or as a licensed social
22worker.
23    (2) Applicants for examination shall pay, either to the
24Department or to the designated testing service, a fee
25covering the cost of determining the applicant's eligibility

1and of providing the examination. Failure to appear for the
2examination on the scheduled date at the time and place
3specified after the applicant's application for examination
4has been received and acknowledged by the Department or the
5designated testing service shall result in forfeiture of the
6examination fee.
7    (3) (Blank).
8    (4) The Department may employ consultants for the purpose
9of preparing and conducting examinations.
10    (5) An applicant has one year from the date of
11notification of successful completion of the examination to
12apply to the Department for a license. If an applicant fails to
13apply within one year, the examination scores shall be void
14and the applicant shall be required to take and pass the
15examination again unless licensed in another jurisdiction of
16the United States within one year of passing the examination.
17    (6) (Blank). Applicants for a license as a licensed social
18worker enrolled in an approved program for a master's degree
19in social work may sit for the authorized examination for
20licensed social workers in the final semester of the program
21for a master's degree in social work without prior approval of
22the Department. The Department may adopt rules to administer
23this paragraph (6). Applicants for a license as a licensed
24social worker must still meet all requirements set forth in
25Section 9A.

3    Sec. 9A. Qualifications for license as licensed social
4worker. A person shall be qualified to be licensed as a
5licensed social worker if that person:
6        (1) has applied in writing on the prescribed form;
7        (2) is of good moral character, as defined in
8    subsection (2) of Section 9;
9        (3)(a) has a degree from a graduate program of social
10    work approved by the Department; or
11        (b) has a degree in social work from an undergraduate
12    program approved by the Department and has successfully
13    completed at least 3 years of supervised professional
14    experience subsequent to obtaining the degree as
15    established by rule. If no supervision by a licensed
16    social worker or a licensed clinical social worker is
17    available, then supervised professional experience may
18    include supervision by other appropriate disciplines as
19    defined by rule;
20        (4) (blank); and has passed the examination for the
21    practice of social work as a licensed social worker as
22    authorized by the Department; and
23        (5) has paid the required fees.

3    Sec. 11. Licenses; renewal; restoration; person in
4military service; inactive status.
5    (a) The expiration date and renewal period for each
6license issued under this Act shall be set by rule. The
7licensee may renew a license during the 60-day period
8preceding its expiration date by paying the required fee and
9by demonstrating compliance with any continuing education
10requirements. The Department shall adopt rules establishing
11minimum requirements of continuing education and means for
12verification of the completion of the continuing education
13requirements. The Department may, by rule, specify
14circumstances under which the continuing education
15requirements may be waived.
16    (b) Any person who has permitted a license to expire or who
17has a license on inactive status may have it restored by
18submitting an application to the Department and filing proof
19of fitness, as defined by rule, to have the license restored,
20including, if appropriate, evidence which is satisfactory to
21the Department certifying the active practice of clinical
22social work or social work in another jurisdiction and by
23paying the required fee.
24    (b-5) If the person has not maintained an active practice
25in another jurisdiction which is satisfactory to the
26Department, the Department shall determine the person's

1fitness to resume active status. The Department may also
2require the person to complete a specific period of evaluated
3clinical social work or social work experience and may require
4successful completion of an examination for clinical social
5workers.
6    (b-7) Notwithstanding any other provision of this Act, any
7person whose license expired while on active duty with the
8armed forces of the United States, while called into service
9or training with the State Militia or in training or education
10under the supervision of the United States government prior to
11induction into the military service may have his or her
12license restored without paying any renewal fees if, within 2
13years after the honorable termination of that service,
14training or education, except under conditions other than
15honorable, the Department is furnished with satisfactory
16evidence that the person has been so engaged and that the
17service, training or education has been so terminated.
18    (c) A license to practice shall not be denied any
19applicant because of the applicant's race, religion, creed,
20national origin, political beliefs or activities, age, sex,
21sexual orientation, or physical impairment.
22    (d) (Blank).

25    (g) The Department shall indicate on each license the
26academic degree of the licensee.
