AMENDMENT TO SENATE BILL 1055

2    AMENDMENT NO. ______. Amend Senate Bill 1055 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Civil Administrative Code of Illinois is
5amended by adding Section 5-647 as follows:
 
6    (20 ILCS 5/5-647 new)
7    Sec. 5-647. Former department employee paid leave.
8Notwithstanding any provision of law to the contrary, any
9former employee of a department of State government as
10provided under this Code shall, upon termination of his or her
11employment with that department, be entitled to compensation
12for any form of unused paid leave time owed to that person, or
13any other lump sum payments otherwise owed to that person,
14within 4 weeks after termination of employment with that
15department. If a department fails to pay any amounts that may
16be owed to a former employee under this Section within the

14-week time period, the department shall incur an interest
2penalty at the rate of 10%, or a prorated percentage thereof,
3for each month the department fails to comply with this
4Section, which shall be paid to the former employee in
5addition to the amounts otherwise owed.
 
6    Section 10. The Illinois Pension Code is amended by adding
7Section 14-130.5 as follows:
 
8    (40 ILCS 5/14-130.5 new)
9    Sec. 14-130.5. Timely determination of eligibility for and
10payment of benefits. Notwithstanding any provision of law to
11the contrary, after receiving a completed application for
12benefits under this Article, the System shall make a
13determination of eligibility for those benefits and begin
14paying those benefits no later than 4 weeks after receiving
15the completed application. If the System fails to pay the
16benefits owed within 4 weeks after receiving the completed
17application, the System shall, in addition to any other
18benefit payment owed to the applicant, pay to the applicant an
19amount equal to 10% of the monthly benefit owed, or a prorated
20percentage thereof, for each month that the System fails to
21pay the benefits owed.
 
22    Section 99. Effective date. This Act takes effect upon
23becoming law.".
