AMENDMENT TO SENATE BILL 1055

AMENDMENT NO. ______. Amend Senate Bill 1055 by replacing everything after the enacting clause with the following:

"Section 5. The Civil Administrative Code of Illinois is amended by adding Section 5-647 as follows:

(20 ILCS 5/5-647 new)

Sec. 5-647. Former department employee paid leave. Notwithstanding any provision of law to the contrary, any former employee of a department of State government as provided under this Code shall, upon termination of his or her employment with that department, be entitled to compensation for any form of unused paid leave time owed to that person, or any other lump sum payments otherwise owed to that person, within 4 weeks after termination of employment with that department. If a department fails to pay any amounts that may be owed to a former employee under this Section within the 4-week time period, the department shall incur an interest penalty at the rate of 10%, or a prorated percentage thereof, for each month the department fails to comply with this Section, which shall be paid to the former employee in addition to the amounts otherwise owed.

Section 10. The Illinois Pension Code is amended by adding Section 14-130.5 as follows:

(40 ILCS 5/14-130.5 new)

Sec. 14-130.5. Timely determination of eligibility for and payment of benefits. Notwithstanding any provision of law to the contrary, after receiving a completed application for benefits under this Article, the System shall make a determination of eligibility for those benefits and begin paying those benefits no later than 4 weeks after receiving the completed application. If the System fails to pay the benefits owed within 4 weeks after receiving the completed application, the System shall, in addition to any other benefit payment owed to the applicant, pay to the applicant an amount equal to 10% of the monthly benefit owed, or a prorated percentage thereof, for each month that the System fails to pay the benefits owed.

Section 99. Effective date. This Act takes effect upon becoming law.".
