1 AMENDMENT TO HOUSE BILL 2504
2     AMENDMENT NO. ______. Amend House Bill 2504 by replacing
3 everything after the enacting clause with the following:

4     "Section 5. The State Records Act is amended by adding
5 Section 17.5 as follows:

6     (5 ILCS 160/17.5 new)
7     Sec. 17.5. Destruction of records of law enforcement
8 misconduct.
9     (a) As used in this Section, "law enforcement agency" has
10 the meaning prescribed to that term in subsection (b) of
11 Section 17.
12     (b) After the effective date of this amendatory Act of the
13 101st General Assembly, a law enforcement agency may not
14 destroy any record relating to complaints, investigations, and
15 adjudications of misconduct by law enforcement officers of the
16 law enforcement agency.

1     Section 10. The Local Records Act is amended by adding
2 Section 4.5 as follows:

3     (50 ILCS 205/4.5 new)
4     Sec. 4.5. Destruction of records of law enforcement
5 misconduct.
6     (a) As used in this Section, "law enforcement agency" has
7 the meaning prescribed to that term in subsection (b) of
8 Section 4.
9     (b) After the effective date of this amendatory Act of the
10 101st General Assembly, a law enforcement agency may not
11 destroy any record relating to complaints, investigations, and
12 adjudications of misconduct by law enforcement officers of the
13 law enforcement agency.".
