AMENDMENT TO SENATE BILL 3001

2    AMENDMENT NO. ______. Amend Senate Bill 3001 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Highway Code is amended by
5changing Sections 4-221 and 4-222 as follows:
 
6    (605 ILCS 5/4-221)
7    Sec. 4-221. Mix designs. To the extent allowed by federal
8law, the Department specifications shall allow the use of
9recycled asphalt roofing shingles received from facilities
10authorized to process asphalt roofing shingles for recycling
11into asphalt pavement in accordance with (i) permits issued
12pursuant to Section 39 of the Environmental Protection Act or
13(ii) beneficial use determinations issued pursuant to Section
1422.54 of the Environmental Protection Act as well as asphalt
15additive agents and binder performance grade modifiers. In
16creating the mix designs used for construction and maintenance

1of State highways, it shall be the goal of the Department,
2through its specifications, to maximize the percentage of
3recycled asphalt roofing shingles and binder replacement and to
4maximize the use of recycled aggregates and other lowest-cost
5constituents in the mix, including asphalt additive agents and
6binder performance grade modifiers, so long as there is no
7detrimental impact on life-cycle costs.

10    Sec. 4-222. Recycled asphalt roofing shingles; cost
11savings; prohibitions on use in asphalt paving.
12    (a) It shall be the goal of the Department, with regard to
13its asphalt paving projects and to the extent possible, to
14reduce the carbon footprint and reduce average costs by
15maximizing the percentage use of recycled materials or lowest
16cost alternative materials, including asphalt additive agents
17and binder performance grade modifiers, and extending the
18paving season so long as there is no detrimental impact on
19life-cycle costs. In furtherance of these goals, the Department
20shall provide to the Chairpersons of the Transportation
21Committee in each legislative chamber, within 60 days after the
22completion of each fiscal year, a written report of the
23activities initiated or abandoned in each district or region
24within the Department to meet those goals during the previous
25year. The report shall also include an analysis of the cost

1savings directly or indirectly attributed to those activities
2within each district or region. Upon review of the annual
3report, the Transportation Committees in each chamber may
4conduct hearings and provide recommendations to the Department
5regarding the performance of each district or region.
6    (b) No producer of asphalt pavement, operating pursuant to
7an air permit issued by the Illinois Environmental Protection
8Agency, shall use recycled asphalt roofing shingles in its
9pavement product unless the shingles have been processed for
10recycling into asphalt pavement in accordance with (i) permits
11issued pursuant to Section 39 of the Environmental Protection
12Act or (ii) beneficial use determinations issued pursuant to
13Section 22.54 of the Environmental Protection Act. The
14prohibition in this subsection (b) shall apply in addition to
15any other rules, specifications, or other requirements adopted
16by the Department regarding the use of asphalt roofing shingles
17in pavement product.
