SYNOPSIS AS INTRODUCED:
 
20 ILCS 1805/22-3  from Ch. 129, par. 220.22-3
20 ILCS 1805/22-6 rep.

    Amends the Military Code of Illinois. Provides that all moneys received from the transfer or exchange of any realty under the control of the Department of Military Affairs pursuant to authority contained in specified provisions, and all funds received from the federal government under terms of the federal Master Cooperative Agreement related to constructing and maintaining real property between the Department of Military Affairs and the United States Property and Fiscal Officer for Illinois shall be deposited (rather than covered) into the Illinois National Guard Construction Fund. Provides that the moneys in the Fund shall be used exclusively by the Adjutant General for purposes including rehabilitating existing facilities and making other capital improvements. Provides that the distributions from the Illinois National Guard Construction Fund provided for in these provisions shall constitute an irrevocable and continuing appropriation. Provides that the Treasurer and Comptroller are authorized and directed to make distributions from the Fund. Removes language providing that expenditures from the Fund shall be subject to appropriation by the General Assembly and written release by the Governor. Makes corresponding changes. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Military Code of Illinois is amended by
5changing Section 22-3 as follows:
 
6    (20 ILCS 1805/22-3)  (from Ch. 129, par. 220.22-3)
7    Sec. 22-3. All monies received from the sale of Illinois
8National Guard facilities and lands pursuant to authority
9contained in Section 22-2, all moneys received from the
10transfer or exchange of any realty under the control of the
11Department pursuant to authority contained in Section 22-5, and
12all funds received from the federal government under terms of
13the Federal Master Cooperative Agreement related to
14constructing and maintaining real property between the
15Department of Military Affairs and the United States Property
16and Fiscal Officer for Illinois shall be paid into the State
17Treasury without delay and shall be deposited covered into a
18special fund to be known as the Illinois National Guard
19Construction Fund. The monies in this fund shall be used
20exclusively by the Adjutant General for the purpose of
21acquiring building sites, and constructing new facilities,
22rehabilitating existing facilities, and making other capital
23improvements. The provisions directing the distributions from

1the Illinois National Guard Construction Fund provided for in
2this Section shall constitute an irrevocable and continuing
3appropriation of all amounts as provided herein. The Treasurer
4and Comptroller are hereby authorized and directed to make
5distributions as provided in this Section. Expenditures from
6this fund shall be subject to appropriation by the General
7Assembly and written release by the Governor.

11repealing Section 22-6.
 
12    Section 99. Effective date. This Act takes effect upon
13becoming law.
