SYNOPSIS AS INTRODUCED:

    Amends the Higher Education Cooperation Act. Provides that the purpose of the Act is to promote interinstitutional cooperation and collaboration, which may involve public-private partnerships leveraging the use of public and private resources to improve outcomes for the higher educational system in this State. Provides that an institution of higher education may participate in the establishment and operation of programs of interinstitutional cooperation with other institutions of higher education or public-private partnerships, or both (instead of allowing a public institution of higher education to participate in the establishment and operation of programs of interinstitutional cooperation with other public institutions of higher education or with nonpublic institutions of higher education or with both public and nonpublic institutions of higher education). Provides that the program of financial assistance is available to public-private partnerships. Provides that the Board of Higher Education may require matching public or private resources from all participants. Makes related changes. Effective July 1, 2016.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Higher Education Cooperation Act is amended
5by changing Sections 2, 3, and 4 and by adding Section 2.5 as
6follows:
 
7    (110 ILCS 220/2)  (from Ch. 144, par. 282)
8    Sec. 2. As used in this Act, unless the context otherwise
9requires:
10    "Board" means the Board of Higher Education. ;
11    "Institution of higher education" means an educational
12organization that is approved and recognized by the Board of
13Higher Education and provides workforce valuable postsecondary
14education.
15    "Private partner" means a business, industry, labor
16organization, not-for-profit organization, association,
17foundation, or corporation that partners with institutions of
18higher education pursuant to an agreement under this Act.
19    "Private resources" means financial support, whether
20direct or in-kind, from a private partner.
21    "Public-private partnership" means an agreement pursuant
22to this Act between any combination of institutions of higher
23education and private partners that leverages resources from

1all parties to improve higher education outcomes.
2    "Public resources" means financial support, whether direct
3or in-kind, generated from a source of public funds.
4    "Nonpublic institution of higher education" means an
5educational organization, other than a public institution of
6higher education, which provides a minimum of an organized 2
7year program at the private junior college level or higher and
8which operates not-for-profit and in conformity with standards
9substantially equivalent to those of the public institutions of
10higher education;
11    "Public institution of higher education" means the
12University of Illinois, Southern Illinois University, Chicago
13State University, Eastern Illinois University, Governors State
14University, Illinois State University, Northeastern Illinois
15University, Northern Illinois University, Western Illinois
16University, the public community colleges of this State, and
17any other public universities, colleges and community colleges
18now or hereafter established or authorized by the General
19Assembly.

3    Sec. 3. Any public institution of higher education may
4participate in the establishment and operation of programs of
5interinstitutional cooperation with other public institutions
6of higher education or public-private partnerships, or both or
7with nonpublic institutions of higher education or with both
8public and nonpublic institutions of higher education. Such
9participation may be by contract or by other means, including,
10but not limited to, the designation of representatives of the
11institution as directors of not-for-profit corporations
12organized for the governance or administration of any such
13program. Institutions Public institutions of higher education
14may participate in interinstitutional programs or
15public-private partnerships that which involve institutions or
16private partners based outside this State.

19    Sec. 4. A program of financial assistance to programs of
20interinstitutional cooperation or public-private partnerships,
21or both, in higher education is established to implement the
22policy of encouraging such cooperation in order to achieve an
23efficient use of educational resources, an equitable
24distribution of educational services, the development of

1innovative concepts and applications, and other public
2purposes.
3    The Board of Higher Education shall administer this program
4of financial assistance and shall distribute the funds
5appropriated by the General Assembly for this purpose in the
6form of grants to not-for-profit corporations organized to
7administer programs of interinstitutional cooperation in
8higher education or to public or nonpublic institutions of
9higher education participating in such programs.
10    In awarding grants to interinstitutional programs or
11public-private partnerships, or both, under this Act, the Board
12shall consider in relation to each such program whether it
13serves the public purposes expressed in this Act, whether the
14local community is substantially involved, whether its
15function could be performed better by a single existing
16institution, whether the program is consistent with the
17Illinois master plan for higher education, and such other
18criteria as it determines to be appropriate.
19    No grant may be awarded under this Section for any program
20of sectarian instruction or for any program designed to serve a
21sectarian purpose.
22    As a part of its administration of this Act, the Board may
23require audits or reports in relation to the administrative,
24fiscal, and academic aspects of any interinstitutional program
25or public-private partnership for which a grant is awarded
26under this Act. The Board may require matching public or

1private resources from all participants. The Board shall
2annually submit to the Governor and the General Assembly a
3budgetary recommendation for grants under this Act.

5    Section 99. Effective date. This Act takes effect July 1,
62016.
