AMENDMENT TO SENATE BILL 2914

2    AMENDMENT NO. ______. Amend Senate Bill 2914 by replacing
3line 19 on page 5 through line 18 on page 6 with the following:
 
4    "(415 ILCS 5/22.59 new)
5    Sec. 22.59. Sanitary landfill operator certification.
6    (a) No person shall cause or allow the operation of a
7sanitary landfill that is required to be permitted under this
8Act unless the landfill has on its operational staff at least
9one individual who demonstrates a practical working knowledge
10of the design, operation, and maintenance of sanitary
11landfills.
12    (b) To demonstrate the practical working knowledge
13required under subsection (a) of this Section, an individual
14must pass, at least once every 3 years, a written exam that
15demonstrates competence in the following areas:
16        (1) unloading, spreading, and compacting of waste,
17    litter collection, and vector abatement;

1        (2) traffic control of vehicles delivering waste;
2        (3) application, maintenance, and inspection of cover
3    and cover requirements;
4        (4) fire control, on-site personnel safety
5    requirements, and contingency plan implementation;
6        (5) leachate control operation, leachate management,
7    and landfill gas management;
8        (6) identification of classes of waste;
9        (7) reporting and recordkeeping;
10        (8) financial assurance and groundwater monitoring
11    requirements;
12        (9) development and implementation of contingency
13    plans, closure plans, post-closure plans, and corrective
14    action;
15        (10) acceptance and disposal of special wastes; and
16        (11) Board and Agency rules and permit requirements
17    governing the operation of sanitary landfills.
18    (c) Written exams used to meet the requirements of this
19Section must be approved by the Agency. Written exams may be
20taken electronically.
21    (d) Notwithstanding any other provision of this Section,
22until July 1, 2019:
23        (1) an individual who is on the operational staff of a
24    landfill that does not accept special waste may demonstrate
25    the practical working knowledge required under subsection
26    (a) of this Section by showing that he or she held on June

1    1, 2016 a valid Class "A" Solid Waste Site Operator
2    Certificate issued by the Agency under the Solid Waste Site
3    Operator Certification Law; and
4        (2) an individual who is on the operational staff of a
5    landfill that does accept special waste may demonstrate the
6    practical working knowledge required under subsection (a)
7    of this Section by showing that he or she held on June 1,
8    2016 a valid Class "A" Solid Waste Site Operator
9    Certificate issued by the Agency under the Solid Waste Site
10    Operator Certification Law and a valid special waste
11    certificate endorsement issued by the Agency under the
12    Solid Waste Site Operator Certification Law.".
