AMENDMENT TO SENATE BILL 2735

AMENDMENT NO. ______. Amend Senate Bill 2735 on page 9, by replacing lines 4 through 10 with the following:

"Section 9. Voluntary disqualification of attorneys representing parties pursuant to a collaborative participation agreement.

(a) Voluntary disqualification of collaborative attorneys and other professionals representing parties under a collaborative participation agreement is a defining characteristic of the collaborative law process. Participation in a collaborative law process is a voluntary act by the parties as well as by their attorneys. Except as otherwise provided in subsection (c), a collaborative lawyer operating under a limited scope liability agreement, as defined by Illinois Supreme Court Rules 11, 13, and 137, not to engage in litigation agrees to be voluntarily disqualified from appearing before a tribunal to represent a party in a proceeding related to the collaborative matter.".
