    Amends the Illinois Identification Card Act. Provides that whenever any application for an identification card is accompanied by a fee, and the application is refused or rejected prior to a review of the applicant's eligibility for the card, the fee shall be returned to the applicant. Provides for the expedited issuance of Illinois Identification Cards, and the fees to be charged by the Secretary of State for expedited issuance. Provides that the Secretary of State shall restrict the issuance of multiple Illinois Identification Cards and Illinois Person with a Disability Identification Cards to 3 per year and 10 total for the life of an individual, with discretion to grant exceptions to those limits. Provides for the expiration and renewal of Illinois Identification Cards and Illinois Person with a Disability Identification Cards. Amends the Illinois Vehicle Code. Provides for the expiration of driver's licenses to non-U.S. citizens. Provides for the expedited issuance of driver's licenses, and the fees to be charged by the Secretary for expedited issuance. Provides that whenever any application for a driver's license or permit is accompanied by a fee, and the application is refused or rejected prior to a review of the applicant's eligibility for the license or permit, the fee shall be returned to the applicant. Effective January 1, 2016.

1    AN ACT concerning the Secretary of State.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Identification Card Act is amended
5by changing Sections 2, 4, 7, 8, and 9 as follows:
 
6    (15 ILCS 335/2)  (from Ch. 124, par. 22)
7    Sec. 2. Administration and powers and duties of the
8Administrator.
9    (a) The Secretary of State is the Administrator of this
10Act, and he is charged with the duty of observing,
11administering and enforcing the provisions of this Act.
12    (b) The Secretary is vested with the powers and duties for
13the proper administration of this Act as follows:
14        1. He shall organize the administration of this Act as
15    he may deem necessary and appoint such subordinate
16    officers, clerks and other employees as may be necessary.
17        2. From time to time, he may make, amend or rescind
18    rules and regulations as may be in the public interest to
19    implement the Act.
20        3. He may prescribe or provide suitable forms as
21    necessary, including such forms as are necessary to
22    establish that an applicant for an Illinois Person with a
23    Disability Identification Card is a "disabled person" as

1    defined in Section 4A of this Act, and establish that an
2    applicant for a State identification card is a "homeless
3    person" as defined in Section 1A of this Act.
4        4. He may prepare under the seal of the Secretary of
5    State certified copies of any records utilized under this
6    Act and any such certified copy shall be admissible in any
7    proceeding in any court in like manner as the original
8    thereof.
9        5. Records compiled under this Act shall be maintained
10    for 6 years, but the Secretary may destroy such records
11    with the prior approval of the State Records Commission.
12        6. He shall examine and determine the genuineness,
13    regularity and legality of every application filed with him
14    under this Act, and he may in all cases investigate the
15    same, require additional information or proof or
16    documentation from any applicant.
17        7. He shall require the payment of all fees prescribed
18    in this Act, and all such fees received by him shall be
19    placed in the Road Fund of the State treasury except as
20    otherwise provided in Section 12 of this Act. Whenever any
21    application to the Secretary for an identification card
22    under this Act is accompanied by any fee, as required by
23    law, and such application is refused or rejected prior to a
24    review of the applicant's eligibility for the
25    identification card, the fee shall be returned to the
26    applicant. If the application is denied after a review of

1    eligibility, which may include facial recognition
2    comparison and social security number verification, the
3    applicant shall not be entitled to a refund of any fees
4    paid.

7    Sec. 4. Identification Card.
8    (a) The Secretary of State shall issue a standard Illinois
9Identification Card to any natural person who is a resident of
10the State of Illinois who applies for such card, or renewal
11thereof, or who applies for a standard Illinois Identification
12Card upon release as a committed person on parole, mandatory
13supervised release, aftercare release, final discharge, or
14pardon from the Department of Corrections or Department of
15Juvenile Justice by submitting an identification card issued by
16the Department of Corrections or Department of Juvenile Justice
17under Section 3-14-1 or Section 3-2.5-70 of the Unified Code of
18Corrections, together with the prescribed fees. No
19identification card shall be issued to any person who holds a
20valid foreign state identification card, license, or permit
21unless the person first surrenders to the Secretary of State
22the valid foreign state identification card, license, or
23permit. The card shall be prepared and supplied by the
24Secretary of State and shall include a photograph and signature
25or mark of the applicant. However, the Secretary of State may

1provide by rule for the issuance of Illinois Identification
2Cards without photographs if the applicant has a bona fide
3religious objection to being photographed or to the display of
4his or her photograph. The Illinois Identification Card may be
5used for identification purposes in any lawful situation only
6by the person to whom it was issued. As used in this Act,
7"photograph" means any color photograph or digitally produced
8and captured image of an applicant for an identification card.
9As used in this Act, "signature" means the name of a person as
10written by that person and captured in a manner acceptable to
11the Secretary of State.
12    (a-5) If an applicant for an identification card has a
13current driver's license or instruction permit issued by the
14Secretary of State, the Secretary may require the applicant to
15utilize the same residence address and name on the
16identification card, driver's license, and instruction permit
17records maintained by the Secretary. The Secretary may
18promulgate rules to implement this provision.
19    (a-10) If the applicant is a judicial officer as defined in
20Section 1-10 of the Judicial Privacy Act or a peace officer,
21the applicant may elect to have his or her office or work
22address listed on the card instead of the applicant's residence
23or mailing address. The Secretary may promulgate rules to
24implement this provision. For the purposes of this subsection
25(a-10), "peace officer" means any person who by virtue of his
26or her office or public employment is vested by law with a duty

1to maintain public order or to make arrests for a violation of
2any penal statute of this State, whether that duty extends to
3all violations or is limited to specific violations.
4    (a-15) The Secretary of State may provide for an expedited
5process for the issuance of an Illinois Identification Card.
6The Secretary shall charge an additional fee for the expedited
7issuance of an Illinois Identification Card, to be set by rule,
8not to exceed $75. All fees collected by the Secretary for
9expedited Illinois Identification Card service shall be
10deposited into the Secretary of State Special Services Fund.
11The Secretary may adopt rules regarding the eligibility,
12process, and fee for an expedited Illinois Identification Card.
13If the Secretary of State determines that the volume of
14expedited identification card requests received on a given day
15exceeds the ability of the Secretary to process those requests
16in an expedited manner, the Secretary may decline to provide
17expedited services, and the additional fee for the expedited
18service shall be refunded to the applicant.
19    (b) The Secretary of State shall issue a special Illinois
20Identification Card, which shall be known as an Illinois Person
21with a Disability Identification Card, to any natural person
22who is a resident of the State of Illinois, who is a person
23with a disability as defined in Section 4A of this Act, who
24applies for such card, or renewal thereof. No Illinois Person
25with a Disability Identification Card shall be issued to any
26person who holds a valid foreign state identification card,

1license, or permit unless the person first surrenders to the
2Secretary of State the valid foreign state identification card,
3license, or permit. The Secretary of State shall charge no fee
4to issue such card. The card shall be prepared and supplied by
5the Secretary of State, and shall include a photograph and
6signature or mark of the applicant, a designation indicating
7that the card is an Illinois Person with a Disability
8Identification Card, and shall include a comprehensible
9designation of the type and classification of the applicant's
10disability as set out in Section 4A of this Act. However, the
11Secretary of State may provide by rule for the issuance of
12Illinois Person with a Disability Identification Cards without
13photographs if the applicant has a bona fide religious
14objection to being photographed or to the display of his or her
15photograph. If the applicant so requests, the card shall
16include a description of the applicant's disability and any
17information about the applicant's disability or medical
18history which the Secretary determines would be helpful to the
19applicant in securing emergency medical care. If a mark is used
20in lieu of a signature, such mark shall be affixed to the card
21in the presence of two witnesses who attest to the authenticity
22of the mark. The Illinois Person with a Disability
23Identification Card may be used for identification purposes in
24any lawful situation by the person to whom it was issued.
25    The Illinois Person with a Disability Identification Card
26may be used as adequate documentation of disability in lieu of

1a physician's determination of disability, a determination of
2disability from a physician assistant who has been delegated
3the authority to make this determination by his or her
4supervising physician, a determination of disability from an
5advanced practice nurse who has a written collaborative
6agreement with a collaborating physician that authorizes the
7advanced practice nurse to make this determination, or any
8other documentation of disability whenever any State law
9requires that a disabled person provide such documentation of
10disability, however an Illinois Person with a Disability
11Identification Card shall not qualify the cardholder to
12participate in any program or to receive any benefit which is
13not available to all persons with like disabilities.
14Notwithstanding any other provisions of law, an Illinois Person
15with a Disability Identification Card, or evidence that the
16Secretary of State has issued an Illinois Person with a
17Disability Identification Card, shall not be used by any person
18other than the person named on such card to prove that the
19person named on such card is a disabled person or for any other
20purpose unless the card is used for the benefit of the person
21named on such card, and the person named on such card consents
22to such use at the time the card is so used.
23    An optometrist's determination of a visual disability
24under Section 4A of this Act is acceptable as documentation for
25the purpose of issuing an Illinois Person with a Disability
26Identification Card.

1    When medical information is contained on an Illinois Person
2with a Disability Identification Card, the Office of the
3Secretary of State shall not be liable for any actions taken
4based upon that medical information.
5    (c) The Secretary of State shall provide that each original
6or renewal Illinois Identification Card or Illinois Person with
7a Disability Identification Card issued to a person under the
8age of 21 shall be of a distinct nature from those Illinois
9Identification Cards or Illinois Person with a Disability
10Identification Cards issued to individuals 21 years of age or
11older. The color designated for Illinois Identification Cards
12or Illinois Person with a Disability Identification Cards for
13persons under the age of 21 shall be at the discretion of the
14Secretary of State.
15    (c-1) Each original or renewal Illinois Identification
16Card or Illinois Person with a Disability Identification Card
17issued to a person under the age of 21 shall display the date
18upon which the person becomes 18 years of age and the date upon
19which the person becomes 21 years of age.
20    (c-3) The General Assembly recognizes the need to identify
21military veterans living in this State for the purpose of
22ensuring that they receive all of the services and benefits to
23which they are legally entitled, including healthcare,
24education assistance, and job placement. To assist the State in
25identifying these veterans and delivering these vital services
26and benefits, the Secretary of State is authorized to issue

1Illinois Identification Cards and Illinois Person with a
2Disability Identification Cards with the word "veteran"
3appearing on the face of the cards. This authorization is
4predicated on the unique status of veterans. The Secretary may
5not issue any other identification card which identifies an
6occupation, status, affiliation, hobby, or other unique
7characteristics of the identification card holder which is
8unrelated to the purpose of the identification card.
9    (c-5) Beginning on or before July 1, 2015, the Secretary of
10State shall designate a space on each original or renewal
11identification card where, at the request of the applicant, the
12word "veteran" shall be placed. The veteran designation shall
13be available to a person identified as a veteran under
14subsection (b) of Section 5 of this Act who was discharged or
15separated under honorable conditions.
16    (d) The Secretary of State may issue a Senior Citizen
17discount card, to any natural person who is a resident of the
18State of Illinois who is 60 years of age or older and who
19applies for such a card or renewal thereof. The Secretary of
20State shall charge no fee to issue such card. The card shall be
21issued in every county and applications shall be made available
22at, but not limited to, nutrition sites, senior citizen centers
23and Area Agencies on Aging. The applicant, upon receipt of such
24card and prior to its use for any purpose, shall have affixed
25thereon in the space provided therefor his signature or mark.
26    (e) The Secretary of State, in his or her discretion, may

1designate on each Illinois Identification Card or Illinois
2Person with a Disability Identification Card a space where the
3card holder may place a sticker or decal, issued by the
4Secretary of State, of uniform size as the Secretary may
5specify, that shall indicate in appropriate language that the
6card holder has renewed his or her Illinois Identification Card
7or Illinois Person with a Disability Identification Card.

12    Sec. 7. Duplicate and corrected cards.
13    (a) In the event an identification card is lost or
14destroyed, or if there is a correction of legal name or
15residence address, or a change in the type or class of
16disability of a holder of an Illinois Person with a Disability
17Identification Card, the person named on the card may apply for
18a duplicate or substitute card, or for a corrected card. Any
19application for a corrected card shall be accompanied by the
20original card being corrected.
21    (b) The Secretary of State, having issued an identification
22card in error, may, upon written notice of at least 5 days to
23the person, require the person to appear at a Driver Services
24facility to have the identification card error corrected and a
25new identification card issued. The failure of the person to

1appear is grounds for cancellation of the person's
2identification card under Section 13 of this Act.
3    (c) Notwithstanding any other provisions of this Act, the
4Secretary of State shall restrict the issuance of multiple
5duplicate identification cards and Illinois Person with a
6Disability Identification Cards to any individual to 3 per year
7and 10 for the life of individual. The Secretary may, in his or
8her discretion, grant exceptions to these limits if the
9applicant for a duplicate card can provide sufficient evidence
10from an official source to establish that a duplicate
11identification card is required. The Secretary may promulgate
12rules to implement the requirements of this subsection. For
13purposes of this Section, "official source" means any document
14or report created by law enforcement, State or federal
15government, the judiciary, and any other entity that the
16Secretary may identify by rule.

19    Sec. 8. Expiration.
20    (a) Except as otherwise provided in this Section:
21        (1) Every identification card issued hereunder, except
22    to persons who have reached their 15th birthday, but are
23    not yet 21 years of age, persons who are 65 years of age or
24    older, and persons who are issued an Illinois Person with a
25    Disability Identification Card, shall expire 5 years from

1    the ensuing birthday of the applicant and a renewal shall
2    expire 5 years thereafter.
3        (2) Every original or renewal identification card
4    issued to a person who has reached his or her 15th
5    birthday, but is not yet 21 years of age shall expire 3
6    months after the person's 21st birthday.
7    (b) Except as otherwise provided in this Section, every
8Every original, renewal, or duplicate (i) identification card
9issued by July 1, 2016 to a person who has reached his or her
1065th birthday shall expire 15 years thereafter be permanent and
11need not be renewed and (ii) Illinois Person with a Disability
12Identification Card issued to a qualifying person shall expire
1310 years thereafter. The Secretary of State shall adopt
14promulgate rules setting forth the conditions and criteria for
15the renewal of all Illinois Person with a Disability
16Identification Cards.
17    (c) By July 1, 2016, every identification card or Illinois
18Person with a Disability Identification Card issued under this
19Act to an applicant who is not a United States citizen shall
20expire on whichever is the earlier date of the following:
21        (1) as provided under subsection (a) or (b) of this
22    Section;
23        (2) on the date the applicant's authorized stay in the
24    United States terminates; or
25        (3) 12 months from the date of issuance, if the
26    applicant's authorized stay is indefinite.

3    Sec. 9. Renewal.
4    (a) Any person having a valid identification card which
5expires on his or her 21st birthday, or which expires 3 months
6after his or her 21st birthday, may not apply for renewal of
7his or her existing identification card. A subsequent
8application filed by persons under this subsection, on or after
9their 21st birthday, shall be considered an application for a
10new card under Section 5 of this Act.
11    (b) Any person having a valid identification card, except
12those under subsection (a), may apply for a one-time renewal,
13in a manner prescribed by the Secretary of State, within 30
14days after the expiration of the identification card. A
15subsequent application filed by that person shall be considered
16an application for a new card under Section 5 of this Act.
17Except as otherwise provided in subsection (c) of Section 8 of
18this Act, any Any identification card renewed under this
19subsection shall be valid for 5 years after the expiration date
20of the identification card as originally issued under Section 5
21of this Act. The Secretary of State, in his or her discretion,
22may provide that applications for the one-time renewal under
23this subsection (b) may be made by telephone, mail, or the
24Internet, subject to any eligibility criteria and other
25requirements that the Secretary of State deems appropriate.

1    (c) Notwithstanding any other provision of this Act to the
2contrary, a person convicted of a sex offense as defined in
3Section 2 of the Sex Offender Registration Act may not renew
4his or her Illinois Identification Card or Illinois Person with
5a Disability Identification Card by telephone, mail, or the
6Internet.

8    Section 10. The Illinois Vehicle Code is amended by
9changing Sections 6-115 and 6-119 and by adding Section 6-122
10as follows:
 
11    (625 ILCS 5/6-115)  (from Ch. 95 1/2, par. 6-115)
12    Sec. 6-115. Expiration of driver's license.
13    (a) Except as provided elsewhere in this Section, every
14driver's license issued under the provisions of this Code shall
15expire 4 years from the date of its issuance, or at such later
16date, as the Secretary of State may by proper rule and
17regulation designate, not to exceed 12 calendar months; in the
18event that an applicant for renewal of a driver's license fails
19to apply prior to the expiration date of the previous driver's
20license, the renewal driver's license shall expire 4 years from
21the expiration date of the previous driver's license, or at
22such later date as the Secretary of State may by proper rule
23and regulation designate, not to exceed 12 calendar months.
24    The Secretary of State may, however, issue to a person not

1previously licensed as a driver in Illinois a driver's license
2which will expire not less than 4 years nor more than 5 years
3from date of issuance, except as provided elsewhere in this
4Section.
5    The Secretary of State is authorized to issue driver's
6licenses during the years 1984 through 1987 which shall expire
7not less than 3 years nor more than 5 years from the date of
8issuance, except as provided elsewhere in this Section, for the
9purpose of converting all driver's licenses issued under this
10Code to a 4 year expiration. Provided that all original
11driver's licenses, except as provided elsewhere in this
12Section, shall expire not less than 4 years nor more than 5
13years from the date of issuance.
14    (a-5) By July 1, 2016, every driver's license issued under
15this Code to an applicant who is not a United States citizen
16shall expire on whichever is the earlier date of the following:
17        (1) as provided under subsection (a), (f), (g), or (i)
18    of this Section;
19        (2) on the date the applicant's authorized stay in the
20    United States terminates; or
21        (3) 12 months from the date of issuance, if the
22    applicant's authorized stay is indefinite.
23    (b) Before the expiration of a driver's license, except
24those licenses expiring on the individual's 21st birthday, or 3
25months after the individual's 21st birthday, the holder thereof
26may apply for a renewal thereof, subject to all the provisions

1of Section 6-103, and the Secretary of State may require an
2examination of the applicant. A licensee whose driver's license
3expires on his 21st birthday, or 3 months after his 21st
4birthday, may not apply for a renewal of his driving privileges
5until he reaches the age of 21.
6    (c) The Secretary of State shall, 30 days prior to the
7expiration of a driver's license, forward to each person whose
8license is to expire a notification of the expiration of said
9license which may be presented at the time of renewal of said
10license.
11    There may be included with such notification information
12explaining the anatomical gift and Emergency Medical
13Information Card provisions of Section 6-110. The format and
14text of such information shall be prescribed by the Secretary.
15    There shall be included with such notification, for a
16period of 4 years beginning January 1, 2000 information
17regarding the Illinois Adoption Registry and Medical
18Information Exchange established in Section 18.1 of the
19Adoption Act.
20    (d) The Secretary may defer the expiration of the driver's
21license of a licensee, spouse, and dependent children who are
22living with such licensee while on active duty, serving in the
23Armed Forces of the United States outside of the State of
24Illinois, and 120 days thereafter, upon such terms and
25conditions as the Secretary may prescribe.
26    (e) The Secretary of State may decline to process a renewal

1of a driver's license of any person who has not paid any fee or
2tax due under this Code and is not paid upon reasonable notice
3and demand.
4    (f) The Secretary shall provide that each original or
5renewal driver's license issued to a licensee under 21 years of
6age shall expire 3 months after the licensee's 21st birthday.
7Persons whose current driver's licenses expire on their 21st
8birthday on or after January 1, 1986 shall not renew their
9driver's license before their 21st birthday, and their current
10driver's license will be extended for an additional term of 3
11months beyond their 21st birthday. Thereafter, the expiration
12and term of the driver's license shall be governed by
13subsection (a) hereof.
14    (g) The Secretary shall provide that each original or
15renewal driver's license issued to a licensee 81 years of age
16through age 86 shall expire 2 years from the date of issuance,
17or at such later date as the Secretary may by rule and
18regulation designate, not to exceed an additional 12 calendar
19months. The Secretary shall also provide that each original or
20renewal driver's license issued to a licensee 87 years of age
21or older shall expire 12 months from the date of issuance, or
22at such later date as the Secretary may by rule and regulation
23designate, not to exceed an additional 12 calendar months.
24    (h) The Secretary of State shall provide that each special
25restricted driver's license issued under subsection (g) of
26Section 6-113 of this Code shall expire 12 months from the date

1of issuance. The Secretary shall adopt rules defining renewal
2requirements.
3    (i) The Secretary of State shall provide that each driver's
4license issued to a person convicted of a sex offense as
5defined in Section 2 of the Sex Offender Registration Act shall
6expire 12 months from the date of issuance or at such date as
7the Secretary may by rule designate, not to exceed an
8additional 12 calendar months. The Secretary may adopt rules
9defining renewal requirements.

12    Sec. 6-119. When fees returnable-drivers license.
13    (a) Whenever any application to the Secretary of State for
14a driver's license or permit under this Article is accompanied
15by any fee as required by law and such application is refused
16or rejected prior to a review of the applicant's eligibility
17for the driver's license or permit, the said fee shall be
18returned to the said applicant. If the application is denied
19after a review of eligibility, which may include facial
20recognition comparison and social security number
21verification, the applicant shall not be entitled to a refund
22of any fees paid.
23    (a-5) If the Secretary of State determines that the volume
24of expedited driver's license requests received on a given day
25exceeds the ability of the Secretary to process those requests

1in an expedited manner, the Secretary may decline to provide
2expedited services, and the additional fee for the expedited
3service shall be refunded to the applicant.
4    (b) Whenever the Secretary of State through error collects
5any fee not required to be paid hereunder, the same shall be
6refunded to the person paying the same upon application
7therefor made within 6 months after the date of such payment.
8    (c) Whenever a person dies after making application for a
9drivers license or permit under this Article, application for a
10refund of the drivers license or permit may be made if the
11person dies prior to the effective date for which application
12has been made, and if the drivers license or permit has never
13been used. The Secretary of State shall refund the drivers
14license or permit fees upon receipt within 3 months after the
15application for a drivers license or permit of an application
16for refund accompanied with the drivers license or permit and
17proof of death of the applicant.
18    (d) Any application for refund received after the times
19specified in this Section shall be denied and the applicant in
20order to receive a refund must apply to the Court of Claims.

23    Sec. 6-122. Expedited driver's license. The Secretary of
24State may provide for an expedited process for the issuance of
25a driver's license, excluding temporary visitor's driver's

1licenses. The Secretary shall charge an additional fee for the
2issuance of an expedited driver's license, to be set by rule,
3not to exceed $75. All fees collected by the Secretary for
4expedited driver's license service shall be deposited into the
5Secretary of State Special Services Fund. The Secretary may
6adopt rules regarding the eligibility, process, and fee for an
7expedited driver's license.
 
8    Section 99. Effective date. This Act takes effect January
91, 2016.
