| 1 | | AN ACT concerning regulation.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 1. Short title. This Act may be cited as the Music | 5 | | Therapy Advisory Board Act. | 6 | | Section 5. Definitions. As used in this Act: | 7 | | "Board" means the Music Therapy Advisory Board. | 8 | | "Music therapist" means a person who is certified by the | 9 | | Certification Board for Music Therapists. | 10 | | "Music therapy" means the clinical and evidence-based use | 11 | | of music interventions to accomplish individualized goals for | 12 | | people of all ages and ability levels within a therapeutic | 13 | | relationship by a credentialed professional who has completed | 14 | | an approved music therapy program. The music therapy | 15 | | interventions may include music improvisation, receptive music | 16 | | listening, song writing, lyric discussion, music and imagery, | 17 | | singing, music performance, learning through music, music | 18 | | combined with other arts, music-assisted relaxation, | 19 | | music-based patient education, electronic music technology, | 20 | | adapted music intervention, and movement to music. The term | 21 | | "music therapy" does not include the diagnosis or assessment of | 22 | | any physical, mental, or communication disorder. | 23 | | "Department" means the Department of Financial and |

| 1 | | Professional Regulation. | 2 | | "Secretary" means the Secretary of Financial and | 3 | | Professional Regulation or his or her designee. | 4 | | Section 10. Advisory board. | 5 | | (a) There is created the Music Therapy Advisory Board | 6 | | within the Department. The Board shall consist of 10 members | 7 | | appointed by the Secretary. The Secretary shall make the | 8 | | appointments to the Board within 90 days after the effective | 9 | | date of this Act. The members of the Board shall represent | 10 | | different racial and ethnic backgrounds and have the | 11 | | qualifications as follows: | 12 | | (1) three members who currently serve as music | 13 | | therapists in Cook County; | 14 | | (2) one member who currently serves as a music | 15 | | therapist in DuPage, Kane, Lake, or Will County; | 16 | | (3) one member who currently serves as a music | 17 | | therapist in Bond, Calhoun, Clinton, Jersey, Macoupin, | 18 | | Madison, Monroe, Montgomery, Randolph, St. Clair, or | 19 | | Washington County; | 20 | | (4) one member who currently serves as a music | 21 | | therapist in any other county in the State; | 22 | | (5) one member who is a licensed psychologist in | 23 | | Illinois; | 24 | | (6) one member who is a licensed social worker or | 25 | | counselor; |

| 1 | | (7) one member who currently employs music therapists; | 2 | | and | 3 | | (8) one representative of a community college, | 4 | | university, or educational institution that provides | 5 | | training to music therapists.
| 6 | | (b) In addition, the following persons may each appoint an | 7 | | ex officio, non-voting member of the Board: the Executive | 8 | | Director of the Illinois Community College Board, the Director | 9 | | of Children and Family Services, the Director of Aging, the | 10 | | Director of Public Health, the Director of Employment Security, | 11 | | the Director of Commerce and Economic Opportunity, the | 12 | | Secretary of Financial and Professional Regulation, the | 13 | | Director of Healthcare and Family Services, and the Secretary | 14 | | of Human Services. | 15 | | (c) The voting members of the Board shall select a | 16 | | chairperson from the voting members of the Board. The Board | 17 | | shall consult with additional experts as needed. Five members | 18 | | constitute a quorum. The Board shall hold its first meeting | 19 | | within 30 days after the appointment of members by the | 20 | | Secretary. Members of the Board shall serve without | 21 | | compensation. The Department shall provide administrative and | 22 | | staff support to the Board. The meetings of the Board are | 23 | | subject to the provisions of the Open Meetings Act. | 24 | | (d) The Board shall consider the core competencies of a | 25 | | music therapist, including skills and areas of knowledge that | 26 | | are essential to bringing about music therapy services to |

| 1 | | communities by qualified individuals. As relating to music | 2 | | therapy services, the core competencies for effective music | 3 | | therapists may include, but are not limited to:
| 4 | | (1) materials to educate the public concerning music | 5 | | therapist licensure; | 6 | | (2) the benefits of music therapy; | 7 | | (3) the utilization of music therapy by individuals and | 8 | | in facilities or institutional settings; | 9 | | (4) culturally competent communication and care; | 10 | | (5) music therapy for behavior change; | 11 | | (6) support from the American Music Therapy | 12 | | Association or any successor organization and the | 13 | | Certification Board for Music Therapists; | 14 | | (7) clinical training; and | 15 | | (8) education and continuing education requirements. | 16 | | Section 15. Report. | 17 | | (a) The Board shall develop a report with its | 18 | | recommendations regarding the certification process for music | 19 | | therapists. The report shall be completed no later than 12 | 20 | | months after the first meeting of the Board. The report shall | 21 | | be submitted to all members and ex officio members of the | 22 | | Board, the Governor, the President of the Senate, the Minority | 23 | | Leader of the Senate, the Speaker of the House of | 24 | | Representatives, and the Minority Leader of the House of | 25 | | Representatives. | 1 | | Internet website. | 2 | | (b) The report shall at a minimum include the following: | 3 | | (1) a summary of research regarding the best practices, | 4 | | curriculum, and training programs for designing a | 5 | | certification program in this State for music therapists, | 6 | | including a consideration of a multi-tiered education or | 7 | | training system, statewide certification, | 8 | | non-certification degree-based levels of certification, | 9 | | support from the American Music Therapy Association and | 10 | | Certification Board for Music Therapists, and the | 11 | | requirements for experience-based certification; | 12 | | (2) recommendations regarding certification and | 13 | | renewal process for music therapists and a system of | 14 | | approval and accreditation for curriculum and training; | 15 | | (3) recommendations for a proposed curriculum for | 16 | | music therapists that ensures the content, methodology, | 17 | | development, and delivery of any proposed program is | 18 | | appropriately based on cultural, geographic, and other | 19 | | specialty needs and also reflects relevant | 20 | | responsibilities for music therapists; and | 21 | | (4) recommendations for best practices for | 22 | | reimbursement options and pathways through which secure | 23 | | funding for music therapists may be obtained. | 24 | | (c) The Board shall advise the Department, the Governor, | 25 | | and the General Assembly on all matters that impact the | 26 | | effective work of music therapists.
