AMENDMENT TO SENATE BILL 839

AMENDMENT NO. ______. Amend Senate Bill 839 by replacing everything after the enacting clause with the following:

"Section 5. The Counties Code is amended by adding Section 5-12025 as follows:

(55 ILCS 5/5-12025 new)

Sec. 5-12025. Standards for noise pollution. The county board or board of commissioners may establish standards for noise pollution in the unincorporated areas of a county; however, those standards must be in accordance with, and no more restrictive than, the regulations included in 35 Ill. Adm. Code 900, 901, 902, and 910. A home rule unit may not establish standards, by any means, in a manner inconsistent with this Section. This Section is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule units of powers and functions exercised by the State.

Section 99. Effective date. This Act takes effect upon becoming law.".
