AMENDMENT TO HOUSE BILL 2658

2    AMENDMENT NO. ______. Amend House Bill 2658 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Police Act is amended by adding
5Section 17b as follows:
 
6    (20 ILCS 2610/17b new)
7    Sec. 17b. Retiring officer; purchase of service firearm and
8police badge. The Director of State Police shall establish a
9program to allow a State Police officer who is honorably
10retiring in good standing to purchase either or both of the
11following: (i) any State Police badge previously issued to that
12officer or (ii) if the officer has a currently valid Firearm
13Owner's Identification Card, the service firearm issued or
14previously issued to the officer by the Department of State
15Police. The cost of the firearm purchased shall be the
16replacement value of the firearm and not the firearm's fair

1market value.
2    Any officer who retires in good standing is eligible to
3purchase his or her service pistol and badge as provided in
4this Section. A good standing separation determination results
5when there are no pending criminal complaints against the
6officer which, if sustained, would result in the permanent loss
7of police powers.
 
8    Section 10. The State Property Control Act is amended by
9changing Section 7 as follows:
 
10    (30 ILCS 605/7)  (from Ch. 127, par. 133b10)
11    Sec. 7. Disposition of transferable property.
12    (a) Except as provided in subsection (c), whenever a
13responsible officer considers it advantageous to the State to
14dispose of transferable property by trading it in for credit on
15a replacement of like nature, the responsible officer shall
16report the trade-in and replacement to the administrator on
17forms furnished by the latter. The exchange, trade or transfer
18of "textbooks" as defined in Section 18-17 of the School Code
19between schools or school districts pursuant to regulations
20adopted by the State Board of Education under that Section
21shall not constitute a disposition of transferable property
22within the meaning of this Section, even though such exchange,
23trade or transfer occurs within 5 years after the textbooks are
24first provided for loan pursuant to Section 18-17 of the School

1Code.
2    (b) Except as provided in subsection (c), whenever it is
3deemed necessary to dispose of any item of transferable
4property, the administrator shall proceed to dispose of the
5property by sale or scrapping as the case may be, in whatever
6manner he considers most advantageous and most profitable to
7the State. Items of transferable property which would
8ordinarily be scrapped and disposed of by burning or by burial
9in a landfill may be examined and a determination made whether
10the property should be recycled. This determination and any
11sale of recyclable property shall be in accordance with rules
12promulgated by the Administrator.
13    When the administrator determines that property is to be
14disposed of by sale, he shall offer it first to the
15municipalities, counties, and school districts of the State and
16to charitable, not-for-profit educational and public health
17organizations, including but not limited to medical
18institutions, clinics, hospitals, health centers, schools,
19colleges, universities, child care centers, museums, nursing
20homes, programs for the elderly, food banks, State Use
21Sheltered Workshops and the Boy and Girl Scouts of America, for
22purchase at an appraised value. Notice of inspection or viewing
23dates and property lists shall be distributed in the manner
24provided in rules and regulations promulgated by the
25Administrator for that purpose.

1to appropriations may, at the discretion of the administrator,
2be sold, pursuant to contracts entered into by the Director of
3Central Management Services or the heads of agencies exempt
4from "The Illinois Purchasing Act". However such equipment
5shall not be sold at prices less than the purchase cost thereof
6or depreciated value as determined by the administrator. No
7sale of the electronic data processing equipment and lease to
8the State by the purchaser of such equipment shall be made
9under this Act unless the Director of Central Management
10Services finds that such contracts are financially
11advantageous to the State.
12    Disposition of other transferable property by sale, except
13sales directly to local governmental units, school districts,
14and not-for-profit educational, charitable and public health
15organizations, shall be subject to the following minimum
16conditions:
17        (1) The administrator shall cause the property to be
18    advertised for sale to the highest responsible bidder,
19    stating time, place, and terms of such sale at least 7 days
20    prior to the time of sale and at least once in a newspaper
21    having a general circulation in the county where the
22    property is to be sold.
23        (2) If no acceptable bids are received, the
24    administrator may then sell the property in whatever manner
25    he considers most advantageous and most profitable to the
26    State.

1    (c) Notwithstanding any other provision of this Act, an
2agency covered by this Act may transfer books, serial
3publications, or other library materials that are transferable
4property, or that have been withdrawn from the agency's library
5collection through a regular collection evaluation process, to
6any of the following entities :
7        (1) Another agency covered by this Act located in
8    Illinois.
9        (2) A State supported university library located in
10    Illinois.
11        (3) A tax-supported public library located in
12    Illinois, including a library established by a public
13    library district.
14        (4) A library system organized under the Illinois
15    Library System Act or any library located in Illinois that
16    is a member of such a system.
17        (5) A non-profit agency, located in or outside
18    Illinois.
19    A transfer of property under this subsection is not subject
20to the requirements of subsection (a) or (b).
21    In addition, an agency covered by this Act may sell or
22exchange books, serial publications, and other library
23materials that have been withdrawn from its library collection
24through a regular collection evaluation process. Those items
25may be sold to the public at library book sales or to book
26dealers or may be offered through exchange to book dealers or

1other organizations. Revenues generated from the sale of
2withdrawn items shall be retained by the agency in a separate
3account to be used solely for the purchase of library
4materials; except that in the case of the State Library,
5revenues from the sale of withdrawn items shall be deposited
6into the State Library Fund to be used for the purposes stated
7in Section 25 of the State Library Act.
8    For purposes of this subsection (c), "library materials"
9means physical entities of any substance that serve as carriers
10of information, including, without limitation, books, serial
11publications, periodicals, microforms, graphics, audio or
12video recordings, and machine readable data files.
13    (d) Notwithstanding any other provision of this Act, the
14Director of State Police may dispose of a service firearm or
15police badge issued or previously issued to a retiring State
16Police officer as provided in Section 17b of the State Police
17Act.

19    Section 99. Effective date. This Act takes effect upon
20becoming law.".
