AMENDMENT TO HOUSE BILL 397

2    AMENDMENT NO. ______. Amend House Bill 397 as follows:
 
3on page 9, line 2, after "Article.", by inserting "If a charter
4school applicant submits a proposal to a local school board
5outside of the process adopted by that local school board for
6receiving charter school proposals on an annual basis, the
7applicant shall not have any right to submit its proposal to
8the Commission as otherwise authorized in subsections (d) and
9(e) of this Section."; and
 
10on page 9, line 24, after "proposal.", by inserting "Final
11decisions of a local school board are subject to judicial
12review under the Administrative Review Law."; and
 
13on page 10, by replacing lines 20 through 26 with the
14following:
15    "(h) The Commission may approve a charter school proposal

1submitted to it in accordance with subsection (d), (e), or (i)
2of this Section The Commission may reverse a local school
3board's decision to deny a charter school proposal if the
4Commission finds that the proposal (i) is in compliance with
5this Article and (ii) is in the best interests of the students
6the charter school is designed to serve. Final decisions of the
7Commission are subject to judicial review under the
8Administrative Review Law."; and
 
9on page 13, by replacing lines 13 through 26 with the
10following:
11    "(e) The Commission may approve an application for a
12charter submitted to it in accordance with this Article Notice
13of a local school board's decision to deny, revoke or not to
14renew a charter shall be provided to the Commission and the
15State Board. The Commission may reverse a local board's
16decision if the Commission finds that the charter school or
17charter school proposal (i) is in compliance with this Article,
18and (ii) is in the best interests of the students it is
19designed to serve. The Commission may condition approval of a
20charter school application The Commission may condition the
21granting of an appeal on the acceptance by the charter school
22of funding in an amount less than that requested in the
23proposal submitted to the local school board. Final decisions
24of the Commission are shall be subject to judicial review under
25the Administrative Review Law.

1    (f) Notwithstanding other provisions of this Article, if
2the Commission approves an application for a charter submitted
3to it in accordance with this Article or on appeal reverses a
4local board's decision or"; and
 
5on page 14, by replacing line 4 with the following:
6"Commission shall execute a approve the charter agreement and
7shall perform all"; and
 
8on page 15, immediately below line 3, by inserting the
9following:
10    "(i) The Commission has no authority under subsection (e)
11of this Section to approve a charter school proposal that has
12been denied by the local school board.".
