AMENDMENT TO HOUSE BILL 5338

AMENDMENT NO. ______. Amend House Bill 5338 by replacing everything after the enacting clause with the following:

"Section 5. The State Treasurer Act is amended by adding Section 20 as follows:

(15 ILCS 505/20 new)

Sec. 20. Default provisions. Notwithstanding any other provision of law, the entity responsible for remitting a fine, fee, or other amount before the deposit of moneys in the State treasury shall remit the fine, fee, or other charge to the administering agency or the agency designated to provide support to the board, commission, or other body. This Section shall apply to fines, fees, or other amounts remitted by circuit clerks, county clerks, and other entities that are not State agencies for deposit into a fund in the State treasury. This Section shall apply only to any form of fines, fees, or other collections created after the effective date of this amendatory Act of the 98th General Assembly.

Section 99. Effective date. This Act takes effect upon becoming law.".
