SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/4-9   from Ch. 38, par. 4-9

    Amends the Criminal Code of 1961. Provides that a person may be guilty of an offense without having, as to each element thereof, one of the mental states described in the Code if the offense is a misdemeanor which is not punishable by incarceration or by a fine exceeding $1,000 (rather than $500), or the statute defining the offense clearly indicates a legislative purpose to impose absolute liability for the conduct described.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by changing
5 Section 4-9 as follows:
 
6     (720 ILCS 5/4-9)  (from Ch. 38, par. 4-9)
7     Sec. 4-9. Absolute liability.
8     A person may be guilty of an offense without having, as to
9 each element thereof, one of the mental states described in
10 Sections 4--4 through 4--7 if the offense is a misdemeanor
11 which is not punishable by incarceration or by a fine exceeding
12 $1,000 $500, or the statute defining the offense clearly
13 indicates a legislative purpose to impose absolute liability
14 for the conduct described.
