AMENDMENT TO SENATE BILL 2089

AMENDMENT NO. ______. Amend Senate Bill 2089 by replacing everything after the enacting clause with the following:

"Section 5. The Public Community College Act is amended by adding Section 3-7a as follows:

(110 ILCS 805/3-7a new)

Sec. 3-7a. Trustee districts in community college district primarily in DuPage County.

(a) A board of trustees of a community college district that is located primarily in DuPage County shall have its board members elected from trustee districts as provided in this Section. In 2011 and in the year following each decennial census thereafter, the board shall reapportion the trustee districts to reflect the results of the decennial census and shall divide the community college district into 6 trustee districts, each of which shall be compact, contiguous, and substantially equal in population to each other trustee district. The division of the community college district into trustee districts shall be completed and formally approved by a majority of the members of the board of trustees of the community college district in 2011 and in the year following each decennial census. At the same meeting of the board of trustees, the board shall, publicly by lot, divide the trustee districts as equally as possible into 2 groups. Beginning in 2013 and every 10 years thereafter, trustees and their successors from one group shall be elected for successive terms of 4 years and 6 years and trustees and their successors from the second group shall be elected for successive terms of 6 years and 4 years. One trustee shall be elected from each trustee district. The seventh trustee and chairperson of the board of trustees shall be appointed by the county board chairman of the largest county within the community college district to serve 5-year terms.

(b) The term of each trustee elected in 2011 shall end in 2013 on the date that the trustees elected in 2013 are officially determined by a canvass conducted pursuant to the Election Code and are sworn into office.

(c) In the 2015 election only, the 4 trustees on the ballot shall be elected to either 2 or 4-year terms in order to have those seats conform with the overall terms of office as provided for new trustees under this Section.

(d) Each member of the board of trustees elected from a trustee district must be a resident of the trustee district he or she represents for at least one year immediately preceding his or her election, except that in the first election for each trustee district following reapportionment, a candidate for the board may be elected from any trustee district that contains a part of the trustee district in which he or she resided at the time of the reapportionment and may be reelected if a resident of the new trustee district he or she represents for one year prior to reelection.

Section 99. Effective date. This Act takes effect upon becoming law.".
