AMENDMENT TO SENATE BILL 290

2     AMENDMENT NO. ______. Amend Senate Bill 290 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Dental Practice Act is amended by
5 changing Sections 9 and 13 as follows:
 
6     (225 ILCS 25/9)  (from Ch. 111, par. 2309)
7     (Section scheduled to be repealed on January 1, 2016)
8     Sec. 9. Qualifications of Applicants for Dental Licenses.
9 The Department shall require that each applicant for a license
10 to practice dentistry shall:
11     (a) (Blank).
12     (b) Be at least 21 years of age and of good moral
13 character.
14     (c) (1) Present satisfactory evidence of completion of
15 dental education by graduation from a dental college or school
16 in the United States or Canada approved by the Department. The

1 Department shall not approve any dental college or school which
2 does not require at least (A) 60 semester hours of collegiate
3 credit or the equivalent in acceptable subjects from a college
4 or university before admission, and (B) completion of at least
5 4 academic years of instruction or the equivalent in an
6 approved dental college or school before graduation; or
7     (2) Present satisfactory evidence of completion of dental
8 education by graduation from a dental college or school outside
9 the United States or Canada and provide satisfactory evidence
10 that:
11         (A) (blank);
12         (B) the applicant has completed a minimum of 2 academic
13     years of general dental clinical training at a dental
14     college or school in the United States or Canada approved
15     by the Department, however, an accredited advanced dental
16     education program approved by the Department of no less
17     than 2 years may be substituted for the 2 academic years of
18     general dental clinical training and an applicant who was
19     enrolled for not less than one year in an approved clinical
20     program prior to January 1, 1993 at an Illinois dental
21     college or school shall be required to complete only that
22     program; and
23         (C) the applicant has received certification from the
24     dean of an approved dental college or school in the United
25     States or Canada or the program director of an approved
26     advanced dental education program stating that the

1     applicant has achieved the same level of scientific
2     knowledge and clinical competence as required of all
3     graduates of the college, school, or advanced dental
4     education program.
5     Nothing in this Act shall be construed to prevent either
6 the Department or any dental college or school from
7 establishing higher standards than specified in this Act.
8     (d) In determining professional capacity under this
9 Section, any individual who has not been actively engaged in
10 the practice of dentistry, has not been a dental student, or
11 has not been engaged in a formal program of dental education
12 during the 5 years immediately preceding the filing of an
13 application may be required to complete such additional
14 testing, training, or remedial education as the Board may deem
15 necessary in order to establish the applicant's present
16 capacity to practice dentistry with reasonable judgment,
17 skill, and safety.
18     (e) Present satisfactory evidence that the applicant has
19 passed both parts of the National Board Dental Examination
20 administered by the Joint Commission on National Dental
21 Examinations and has successfully completed an examination
22 conducted by one of the following regional testing services:
23 the Central Regional Dental Testing Service, Inc. (CRDTS), the
24 Southern Regional Testing Agency, Inc. (SRTA), the Western
25 Regional Examining Board (WREB), or the North East Regional
26 Board (NERB). For purposes of this Section, successful

1 completion shall mean that the applicant has achieved a minimum
2 passing score as determined by the applicable regional testing
3 service. Pass an examination authorized or given by the
4 Department in the theory and practice of the science of
5 dentistry; provided, that the Department (1) may recognize a
6 certificate granted by the National Board of Dental Examiners
7 in lieu of, or subject to, such examination as may be required
8 and (2) may recognize successful completion of the clinical
9 examination conducted by approved regional testing services in
10 lieu of such examinations as may be required. For purposes of
11 this Section, successful completion shall mean that the
12 applicant has achieved a minimum passing score on the regional
13 examinations as determined by each approved regional testing
14 service.

18     Sec. 13. Qualifications of Applicants for Dental
19 Hygienists. Every person who desires to obtain a license as a
20 dental hygienist shall apply to the Department in writing, upon
21 forms prepared and furnished by the Department. Each
22 application shall contain proof of the particular
23 qualifications required of the applicant, shall be verified by
24 the applicant, under oath, and shall be accompanied by the
25 required examination fee.

1     The Department shall require that every applicant for a
2 license as a dental hygienist shall:
3     (1) (Blank).
4     (2) Be a graduate of high school or its equivalent.
5     (3) Present satisfactory evidence of having successfully
6 completed 2 academic years of credit at a dental hygiene
7 program accredited by the Commission on Dental Accreditation of
8 the American Dental Association.
9     (4) Submit evidence that he holds a currently valid
10 certification to perform cardiopulmonary resuscitation. The
11 Department shall adopt rules establishing criteria for
12 certification in cardiopulmonary resuscitation. The rules of
13 the Department shall provide for variances only in instances
14 where the applicant is physically disabled and therefore unable
15 to secure such certification.
16     (5) (Blank).
17     (6) Present satisfactory evidence that the applicant has
18 passed the National Board Dental Hygiene Examination
19 administered by the Joint Commission on National Dental
20 Examinations and has successfully completed an examination
21 conducted by one of the following regional testing services:
22 the Central Regional Dental Testing Service, Inc. (CRDTS), the
23 Southern Regional Testing Agency, Inc. (SRTA), the Western
24 Regional Examining Board (WREB), or the North East Regional
25 Board (NERB). For the purposes of this Section, successful
26 completion shall mean that the applicant has achieved a minimum

1 passing score as determined by the applicable regional testing
2 service. Pass an examination authorized or given by the
3 Department in the subjects usually taught in approved programs
4 of dental hygiene, which examination shall determine the
5 qualifications of applicants to perform the operative
6 procedures of dental hygiene. The Department may recognize a
7 certificate granted by the National Board of Dental Examiners
8 in lieu of, or subject to, such examination.

10     Section 99. Effective date. This Act takes effect upon
11 becoming law.".
